I have an E2 visa in my passport, after securing a job at a school in Korea. However, I couldn't fly due to health reasons, and lost the job.
So I need a new E2 Visa.

I'm now having interviews and ready to send my documents off for a second E2 visa, but the last date of entry on the one I already have is 12 May 2009.

Does anyone know whether I can apply for a new visa before the date of entry expires?
I didn't actually leave the UK, or begin working for the school.
I'm hearing a lot of conflicting opinions, if anyone could help me out it would be much appreciated!

Are you planning to keep posting this question until you get an answer you like?

The answer to your question is the same as it was the last time you asked: Immi will not process your paperwork for a new E-2 while you still have a valid E-2 outstanding.

Not an answer I like, just trying to find the correct one.

I have been told by two agencies that I can do it, as I did not enter Korea. If I simply wanted to hear that, my documents would be in the post already.

And, as you kindly point out, I've also been told I cannot. I'm posting again, to see if anyone else can offer any advice.

The fact that you didn't enter Korea is immaterial (until 90 days elapse, that is). You have a valid employment visa tied to a specific employer. Until that visa is cancelled (unlikely) or until it expires (90 days after issue), Immi will not process an application for a new one. The reason is simple: you cannot have two valid visas of the same type at the same time. They will not process you for a new one until the current one is cancelled or expires.

OP,

Pay no attention to what others are telling you... Ut videam is giving you the correct answer - Immigration wiil not process an application for a second visa while you currently hold a valid visa... i.e. you cannot hold two visas at the same time.

An E-2 expires 90 days from the date of issue (I assume this is where you get the date of May 12). You have until that date to enter K-land and start your one-year period of sojourn - the beginning of the period of sojourn is calculated from the date of entry to the country.

Until your current visa expires, you will not be issued another visa.
