Severance Pay - what's the deadline?

I'm sure this question has been asked in this forum but I can't find it (we need a better site search engine, Dave!). If you move from one school to another at the end of your contract, how long does your school have legally to pay your severance? And what do you do if they don't? My girlfriend's school is telling her they will pay a month from the end of her job, and that doesn't sound right...

Severeance pay must be given with the last pay, at least this is what I have heard and would expect

Correct me if I'm wrong but according to the Korean labor standards act, any money owed to employee including severance must be paid within 14 days from the last day of work.

last year i got my severance on the day the contract ended!

I moved from one PS/city to another last year... It took my former school about 4 wks to pay my severance. They took the remaining money I owed for utilities out of my severance before they sent it to me, but I agreed to that beforehand. It simply varies from school to school, etc..

Ramen is write, legally severance should be paid within 14 days after the end of your contract.

Unfortunately, they actually do have a month. Like Ramen said, you should get paid within two weeks. However, the labor board won't accept any complaints about late pay until two weeks after the supposed deadline. For example, if your last day is June 30th, you should get everything owed to you by July 14th. However, the labor board won't make any inquiries until after July 28th, effectively giving your boss one month to pay you. It doesn't matter if you tell them that your boss plans to pay you late; the benefit of the doubt is given to your boss ("Maybe he'll pay you on time... let's wait and see").

Now, that having been said, your girlfriend could still try talking to her boss and explaining (politely but firmly) that she should be paid no later than 14 days after the contract ends.

im curious if the contract finishes and the person leaves korea, do they put the severance in their american (or whatever) bank account?

No, as per labor law, they have 2 weeks after the last day of employment to pay it. But as someone else already mentioned, the Labor Board won't take your complaint until the money is 15 days late, effectively a month after you finish.
