Hi,
1. What is a letter of release exactly?
2. Do I have to get one from immi that my university signs, or does my university need to write one up?
3. If they need to write one up, then what is it supposed to say?
The English office sec. has said a form I signed last week is an LOR, but I don't think it is. The form is one sentence and basically says, I stop teaching from this date at the university. I think they are just telling me this is an LOR just to shut me up.
I'm halfway through a 1 year contract and leaving according completely to the terms and conditions of my universities contract and may be going to another uni in Korea (or I may gather some sanity and leave Korea.)
Please only respond if you are sure about this issue.
Thanks
P.S I have been wanting to post this for days, but this site just hasn't been loading. |

A letter of release's states that you are released from your employment contract.
2. Do I have to get one from immi that my university signs, or does my university need to write one up?
Copy and paste this on a word file. This is the letter.

See above.
Really they don't need to give you a letter of release if the report to immigration that they have ended your contract. They are supposed to do this 15 days after the termination of your contract, and then you will receive a 15~30 day exit order. Ask your school if they terminated it through immi, and then go get your exit order from immigration. Ask them for 30 days if you need it. |

So as long as they inform immi I've left that'll do and the LOR is unnecessary?
The thing is im finishing around the 22nd august and i will probably be starting at another uni on or around the 1st sept, so is there going to be any way of transferring the visa? Will I need to get a new crim check and all that crap in order to start at the other university? |

You can only transfer a visa if you worked for 9 months or more at the current workplace.
I hired a teacher who had submitted his CRC, and then his workplace went under. We were able to get a visa for him without a CRC. Some speculated that it was because it was within 6 months of the issuance of the CRC. Immigration stated awhile back that once you submitted a CRC, you wouldn't need to submit another one. However, many people here have posted that they needed to submit another one.
It might vary depending on the immigration office/officer. We have often heard of multiple conflicting responses from the same immigration office.
My suggestion: Contact the immigration office that will give you the next visa, and ask them three times. And, get another CRC just in case. |

I have been working at the university for one and a half years from september. I renewed my visa in feb.
Does that mean I'm classed as over the 9 month limit?
Good this sounds like it's going to be a bureaucratic nightmare. It's making me want to leave. |

I would stipulate that it puts you over the 9 month rule, but who knows what immigration will do.
If you do transfer you visa, the LOR needs to specify a date, and the new employer needs to take on your visa the next day, so that you are always tied to someone.
I have read too, that you should make sure that when you transfer your visa that you make sure immigration gives you another year, or at least be aware of how long they gave you on the new visa. |
