|
|
My friend signed on to be a tour guide in Thailand for 2 weeks during summer vacation. She asked her public school for permission, or requested her vacation (gave them the details about what she would be doing and where) in writing about a month ago, and they said "yes".
Now, all of the sudden, they are afraid of swine flu, so they told her if she goes and leaves the country they will FIRE her. Not only has she sunk a bunch of money into this trip, but she's commited to a volunteer job with a program.
What should she do?

She shouldn't have told her handlers about what she'll be doing (working) in Thailand.
Anyway, she should just tell the handlers that she'll be vacationing in Thailand. If they ask if she'll be working there, just say "NO" or "none of their business. She'll be vacationing!"
They can't fire her for taking her vacation, seriously. |

Golden rule. Don't tell your school what you are doing during the vacation. ESPECIALLY, with this swine flu thing, they'll obviously overreact as they did.
The catch is. If you are just going "to be relaxing at home". They'll feel nothing changing your vacation dates at the last minute etc.
So, you tell them you are going to Jeju, and your flights are booked, and you can't get a refund and it will be impossible to reschedule since it's peak season, and they'll understand.
My school thinks I must have a wife in Jeju, cause I "go there" every vacation, and whenever there is a staff trip or weekend event, or bonus time off, I've booked tickets to Jeju |

I believe public school contracts say that you can't take a second job. That is very likely the issue here, not swine flu. |

According to the school it has nothing to do with anything but swine flu. They don't want her to leave the country at all, period. I believed she asked (just out of curiosity) if she could go to China, or somewhere else abroad instead, and they said no because of swine flu. Dunno though, perhaps they are just saying that to cover up the real issue... |

Get it in writing-the warning to fire her.

A second job in Korea. They can't do much if she is out of the country. She definitely shouldn't have told them what she was doing, though. |

This would qualify as an unjustified firing. Your friend should find the section of the labor code where it says this, and then she should say "here is what the labor code says. If you break this rule, I will go to the labor board and have them bend you over a table." |
