...am I obligated to fulfill the remainder of my contract with the new owner or am I free to seek a new position? I looked on EFL-law for an answer to this question and didn't see anything...

You don't work for the school technically. Your contract is conditional not only upon the school, but the employer him/herself. If your school is sold to a new owner, your contract is void. You, of course, have the option to sign a new contract with the new employer, but not obligated to do so. You are thus, free to find a new job.

may not be important... but i would, at all costs, get a letter of release.. it only takes a few minutes.

My hogwan has just been sold and the new owner has told me he will fulfill the remaining portion of my contract (5 months) with severence pay upon completion. I plan on getting him to sign the same contract with his name on it, however I am unsure about my E2 visa. Is it still valid with the new owner or do I need to get another one? I am concerned about this because I really want the severence at the end (one of the main reasons I'm staying), but don't want to get screwed 2 weeks before I finish by getting 'let go'. Anyone have any input?

Cankassel, you need to get a new E2 visa. With the sale of the school, your current contract is void and the previous owner must notify immigration that he has sold the school and that he wishes to void your E2 sponsorship. You will need to do a visa run. Not matter what your new boss may say, you must get a new E2 and he must complete all the paperwork with immigration for a new blue paper to facilitate this. Cool

Yeah, kinda worried the new boss being face with sending me to Japan with only 4 1/2 months to go will just push me out the door and find another teacher to replace me. I think this is a distinct possibility (why would he spend the cash on a visa run with such a small 'return on investment'?). I just don't trust him since I only met him last week Confused
