Does severance ever include overtime if it has been regularly paid? I heard and understand it's the average from the last 3 months, so I guess it can't be just the base salary. I just want to confirm. |

I don't remember the exact clause in the Labor Law, but 'average salary' is defined there. Your severance should be the average of the previous 3 months' pay including overtime or bonuses. |

I was trying to learn this last year and ttompatz gave the links for the labor law in the above topic.
It is certainly an average of ALL money or things of value you receive from your employer during the last three months. The only thing I'd like to know, which I don't know, is whether payment for previous months' work made in the final three months counts. I think and hope it does because I usually end up getting paid for after school classes each semester instead of each month. |

If they don't, then they need to definitely take into account the extra money that would theoretically go into your 13th month. All that stuff has to get squared away before you leave or move on to another school. |
