I'm sure it's been mentioned before...but I got my state cbc back and since they no longer accept local checks....I'm stuck w/ this one.
The misdemeanor was dismissed. Is this going to affect my visa approval and/or will they want to discuss this in chicago at the korean consolate?
I reallllly want to do this program. Any insight would be helpful.

OK, jamo, trying to a find definitive information regarding what will disqualify someone from being issued an E-2 visa is NOT easy to find (I looked in lots of places for you).
Here's a quote from another thread from Dave's posted in 2007:

I've also seen in more than one place, that DUI/DWIs will also disqualify expats from receiving E-2 visas.
Found nothing that specifically addresses charges that have been dismissed.

You're quite welcome, jamo. Sorry I couldn't find more.
Since you reaaaalllllly want to work in Korea, my advice then is to go ahead and have CBC affixed with apostille, and submit. They will or won't reject your application, but you'll never know until you do, right? The fact that the charge was dismissed (I assume stated clearly on the CBC) greatlly increases the likelihood of being approved for an E-2. But truly, I have no idea. Trying to enter the mind of some Korean immigration official is completely beyond my wildest abilities!

Immigration says on the website that they now require either "federal, provincial, state autorities."
That being said, I've heard plenty of people on here recently say that they only submitted local and were approved, and some who submitted local and were denied for that reason. It depends on if the immigration officer was paying attention maybe?
Someone also said that only the private schools require the state, and that the public schools still accept local, but on the immigration website it doesn't say anything about the difference that I can find. The only thing it says is state/provincial or higher. |

I submitted a local CBC and was approved. I didn't realize they reqired federal or state. |

| kabrams -- when were you approved? I heard this "law" took affect two weeks ago. My recruiter just told me it's a no go...I'd be denied. |

Why wouldn't they accept a local background check? Anyway, I did use a state background check. Most people do. If you go through the department of public safety that's consider a state check as far as I know.
When it comes to misdemeanors, many immigration officials have accepted people with DUIs when they were in Korea. I am not sure about people who are outside of Korea and trying to get a visa. A misdemeanor for alcohol doesn't necessarily lead to an exclusion as far as I know. |
