Dear all
My contract runs out in three weeks, I have been with the same school for two years.
Due to poor student numbers my boss is closing down the REI English side of the school. We have had 4 different Korean teachers in the past year, the first was a drunk, the next moved to Seoul (nice lady) the next I don't know what happened there.
My contract ends in the later part of March, but my boss wants to close the school at the end of Feb. I don't mind this that much.
My problem is my boss doesn't want to pay me my contract bonus. Now I admit I feel bad about wanting the money. The Korean side of the business (maths, science etc) is doing well.
I think by law he has to pay me the bonus?
I need the money to pay some bills back home, but I feel bad. It was my birthday two weeks ago and he bought me a nice suit.
I hate been put in this situation. I feel like the greedy westerner.
Last year he tried to get out of paying me the bonus. He paid me and I signed a second year contract (same pay, I like the school) I was promissed that this would not happen again, one year later same thing.
I like my boss but a contracts a contract. I stuck to my side of the contract, so I feel he should. He's the one with the big BMW, not me.
What would you do?
My second question is does any one know the best way to get to Incheon airport from Suwon City? I have a lot of baggage.

Contact the labour board and tell them your situation. They may or may not be able to intervene. Can't hurt to ask them.
Sorry if that's not the advice your looking for, but it's the best I could think of to get a firm answer on whether or not you can use the labour standards act to get the money.

Your contract was for a year I take it, so he still has to paye the bonus. The only way they cannot give you a bonus is if you sign a contract for less than a year i.e 50 weeks say. Some hogwons and education honchos will try and con you into doing this.
You could suggest that he reduce the payment required, because you wont be working the whole year. Act of good faith and all that. Since you will be working 11 months, ask for 11/12ths of your seversnce.
Incidently the Korean Supreme court passed a ruling a while back that illegal workers who did their time were still entitled to severance. So their is no way you shouldn't get yours. |
