EMPLOYMENT AGREEMENT
employee) agree to the following terms for the employment as a teacher on _______________2009.

1. Period of contract:

From September 1st, 2009 To August 31st, 2010 (One year)

2. Working days: 5 days per weeks (Mon.-Fri.)

3. Teaching hours: up to 30 hours per week

4. Obligations to work:

a. Any activities related to teaching English to the students.

b. To observe all the laws and regulations and take personal responsibility for any illegal acts by the employee.

c. To notify employer at least six weeks in advance when the employee wants to resign.

5. Payment:

a. 2.1 million won will be paid per month on the tenth of each month.

b. Overtime hours will be paid 20,000 won per hour. In fact, when you teach 5 hours over time a week, you will be paid 500,000 won for overtime pay each month.

c. Severance pay: When you complete your contract, you will receive a severance pay equal to one month's pay, excluding any and all overtime pay.

d. When you miss your classes, the same amount of money will be deducted from the payment.

6. Holidays:

You will have holidays according to Korean calendar. In addition, you will have 10 days off according to our school schedule.

As a couple you are entitled to identical days off from school schedule, however these days will only be available according to the schedule of the school.





7. Air fare:

Upon completion of your contract, you will be paid 1.5 million won for your airplane ticket. When you arrive, I will give you half of the money (750,000 won) upon your request.

8. Housing:

Rent is free!

You will stay in your own studio apartment. The apartment is supplied with telephone, internet, TV, VCR, bed, refrigerator, washing machine, air conditioner and kitchen appliances, etc. You are responsible for the utility bills.

9. Tax:

You are to pay 3.3% of your payment for the tax each month.

10. Health Insurance:

You are to pay 50 % of the health insurance bill every month.

It will be 2.6 % of your payment each month.

11. Pension:

50% paid by the employee, the other 50% supported by the employer.

Before going back home, you will receive the total amount from the pension office.

12. Governing Laws:

This agreement shall be governed and constructed by the laws of the Republic of Korea.

13. Termination:

Notwithstanding the above section, the employer reserves the right to terminate the agreement on the occurrences of the following events.

a. The failure of the obligations defined in section 4.

b. The failure by the employee to carry out one�s duties.

I love it!... especially the 'notwithstanding clause' in a contract written by someone who can't write a contract.

Say "Next", move on (and don't look back). Wink

Isn't the severance pay suppose to be computed as: total pay (including overtime) over last three months divided by three?

I believe that clearly violates Labor Law.

I'd agree - pass on this one...
