Overseas Custody Rights: American Parents Struggle to Reunite with Children in Japan
http://www.stripes.com/article.asp?section=104&article=64003

This article tells us about the outrageous legal situation regarding custody rights for non-Japanese parents in Japan.

Does anyone know the custody rights for non-Koreans in Korea?

That's good information to know if you have a kid with a Korean.

If the situation is like the situation in Japan, the foreign community needs to pressure the Korean government to change their laws.

Cool

I believe that Korea is a signatory nation to the Hague. But getting that enforced on the ground in a country where you don't speak the language and the courts are set up for Koreans may be a difficult matter. It's always better to try and work together, even in a divorce. Doing otherwise can hurt the children.

If you were married to a Korean and worried about the possibility of a divorce, it would be better to be in your own country where you know the rules.

I THINK the rule of thumb in Korea favors the mother. I do know that if you have a korean child and get divorced for reason, then you can get a residency if you want to raise the child in Korea, regardless of how long you've been married (like if you've only been married a year.) Now, the info I'm talking about was specifically talking about women married in Korea and who divorce for reason (cheating, abuse, etc) and worry about their children. It didn't say anything about foreign fathers.... so I don't know.

Nope. Neither Japan nor Korea is.
