Is it legal not to provide pension to an employee?

I am so confused about this independent contractor status as compared to employee.

Don't sign a contract that doesn't say you are the Employee. And it should also specifically have a provision for pension--50/50.

Worse case scenario: Negotiate to have 4.5% added on top of the basic wage they are offering if they are bound and determined to call you an independent contractor. And make sure you get health insurance coverage paid for too, 50/50.

Then wait for it... an 11th month firing so there will be no dispute over severance pay.
