Hello,

Let's say in a hypothetical situation you need a teacher to sub for your classes on a long term basis and your boss is asking you to pay them out of your pocket/salary instead of putting them on his books? What are the legal issues or implications for you and the school? Any ideas or suggestions?

Sounds like big trouble.
Basically it is illegal to work at two different schools(or employers) on the same E2 visa so if things went sour then he could screw the both of you over.

It's illegal. The sub would be teaching illegally and the repercussions would be againt the school and the sub, if they were caught. There may be some againt you, as you are paying the sub. It is just like the school employing an illegal teacher. The reality is though, you would probably have no problems in doing it.

Yes subsitute foreign teachers are basically illegal. That is why most schools hate giving foreigners sick days and vacation days.

But your problem is more than the school needing a foreigner for a few weeks or days. Let me guess you want to go on vacation and the school says okay. They promised paid vacation but they want YOU to pay the foreign teacher for the time he covers. And any teacher who covers for you does not want to get what you get normally for that time. Heck a sub could cost upwards of 40,000 per hour.

Simply put you should not pay! It is the school responsibility to cover for you. You can help find someone to cover. And you can ask the school to pay your wages to the sub(acutal if you get 1.9 for a month the sub gets 1.9 for the month). But paying your wage to sub is whether you are kind enough or fair enough.

Of course if you are going on vacation and you did not give enough warning and I mean at least 2 weeks or more I can understand the school being annoyed and wanting you to pay for your little screw up.

But if the school got the warning of you going and spent the 2 weeks pulling their puds it is not your responsibility. It is the smart school that has a substitute plan for missing foreign teachers.
