Hey! I was just wondering if anyone had any advice about getting a letter of release from a reluctant employer.
My husband's current school asked him to finish his contract two weeks before the end and told him to get another job. He found one the next week. His current director agreed to give him the release letter, but when he checked on it this week she said she'd only give it to his new school and to have them call her. His new school called, but it turned out she (the current director) was just trying to get the new school not to hire him.
The new school told him they want it taken care of in the easiest way, but he'd have to do it. As money is an issue and he only has another week to get all the paperwork together for a brand-new visa, does anyone have any suggestions for us?

He should have said "no, i'll finish the last two weeks of my contract because i'd like to receive my severance and airfare. i'm sorry i can't let you save a few million won by pulling this sneaky, underhanded tactic at the last minute. it was very clever of you trying to make it appear as though i resigned - making it impossible for me to make a case at when labor board when i realized the horrible mistake i made if i had agreed to your ridiculous request" |

.If you dont want to work there, normally you would put in your notice and leave (30 days i think is the going rate by law). however, i beileve you can go to immigration and cancel anytime.
normally, once youve served your notice (and they refuse to give you a release), you would go to immig. and ask/demand an 'exit order'. you then have 3 months to mess about and decide what you do with your life while still in korea and you are no longer tied to yet another altruistic hogwan owner.
In the meantime, the 'korean labour board' will advise you if they have fired you unfairly and probably take action against the hogwan owner (if he doesnt play by the rules). You can also tell the current hogwan owner that you have approached the 'korean labour board' and that you now know that what they are suggesting is illegal and see if this helps. Usually hogwan owners rely on thier employees ignorance and play this card. your card is that you are not at all ignorant of the law.
in brief,
you can cancel your visa anytime - ie exit order (you dont need a release letter)
it is illegal of them not to give you at least 30 days notice and you can prosecute/threaten to prosecute if they dont live up to this (and they will probably know this).
