I was recently sexually assualted and phyically assaulted by a Korean. He has been caught and sent to jail. He is 18 yrs old (apparently a minor in this country). I have contacted my embassy and even the korean media. He is currently awaiting his sentence. Does anyone know the punishment for this sort of crime here and what can I do to ensure that he will get the maximum punishment?

Maybe things work differently here but I remember that back in the 'States you usually want to keep this kind of stuff hush-hush. Something about talking about it online can upset the strength of your case?

It wouldn't hurt to keep to the safe side, remove as many details as possible and stick to PMs.

Interesting you chose to title the thread "Crimes against foreigners", when your OP only refers to crimes committed to themselves.

As if you were inviting other people to post their experiences of Koreans committing crimes to foreigners.

Your thread title smells like a troll. If what you say is true, then I'm sorry for your experience and it is great that they caught the guy and he is being convicted. You should know that Korea doesn't have a Common Law system like the US and CAnada.

Under 20 calendar years of age is a minor under Korean law.

Your embassy most likely informed you of the limits of their assistance. They can direct you to lawyers proficient in your language.

All the media can do is cover the case. In case you haven't noticed of late, the Korean media is not doing a stellar job of reporting on crimes by or even against foreigners.

Check the news reports and you'll see that rapists do not get heavy punishments here.

I'm sorry to hear about your assault. I hope you have some supportive people to talk to. There was a thread not to long ago on sex offenders getting lenient sentences. On that thread, someone posted a list of support services. It's not too extensive, but there should be someone out there that can give you the advice and support that you need.

I shouldn't know anything...I just got here two months ago. I had a horrible thing happened to me and turned to this message board for some information about Korean Law.

If he's 18 years old, then that means he's about 17 western age. I assume that means he's definitely underage. In Canada, kids would get slaps on the wrist, I assume in Korea, he'd be given even less. Maybe a suspended slap.

I'd like to know more details though, just so that I can tell my GF to avoid that area.

Even if the kid gets jail time, he may see very little of it. Every year the President pardons mega thousands of people and does his bit to empty the prisons and put the crims back on the streets. Its an act of kindness!

I live in the nowon area. so, north east seoul. from what they have told the embassy, he is already out of custody and will most likely only have to pay a fine. I have not been contacted by the prosecutor's office. They are saying that because he didn't actually rape me, he didn't commit a serious crime. the story will be featured on channel 5 news tomorrow night in seoul. Crimes like this, should not go unpunished... no matter where you live.

I find it hard to believe that a sexual assault would make the news.

Usually its only when the offendor racks up about 100 such assaults that it makes it into the papers.

For all legal issues, "Western Age" is what's used, not "Korean Age."
