Immigration is questioning my criminal background check?

I hope somebody can help me with this. I plan to call my state's Department of Justice to ask them about it, but I am hoping somebody else can help me out.

I sent all my documents to a school earlier this week, and they received it on the 6th in Korea. When the director brought it to immigration, they basically told him the apostilled CBC had to be within THREE months. They also questioned him on the fact that there wasn't a government official's signature on the CBC to denote that the government made the check. They told him they would like an adequate explanation as they did not reject the documents. So I am trying to help him out with a proper explanation.

In California we are required to do a live-scan fingerprinting, which is under an authorised agent, sent to DOJ, then a letter is automatically generated and sent to the requester. I don't think it is done any other way. I had it notarised and everything too, so I am not sure what the problem is. And I thought the CBC had to be within SIX months, not three? Aigoo.

I don't know how much help I'll be because I haven't gone yet, but this is what I just got from the California DoJ:

I did the LiveScan fingerprinting, and they sent me a sheet saying nothing had come up. But it didn't have any seals or signatures or anything, so I called them and asked for one that did. They sent me that. Hope that helps somehow?

I explained my situation to the DoJ, and they told me what was supposed to happen. They are sending me another CBC with a cover letter attached. I have no idea if I will need to get it notarised and apostilled again, but knowing my luck most likely. Immigration did take my documents, but wanted an explanation for why it happened so I am a little hopeful. DoJ told me the Secretary of State Office kind of screwed up too so I don't feel wholly responsible.

Funny enough I asked nearly 5 different people who professionally do this for a living about this and they never told me this was what I was supposed to do. Oh the joys of a vague system that sends you in circles. And the people involved in them.

What number did you call to get a real person at the DOJ? Did you have to re-submit your livescan request to get the cover letter?

Hi. I called (916)227-3849 and just waited until the end to speak to a representative. Leaving a message works too: they usually get back to you within the same day. You don't have to redo the live scan. Just explain to them your situation and that you need a signature because it is for a visa to Korea. It is very simple and shouldn't take too long at all.

I'm already in Korea and have been waiting forever for my ink fingerprints to be processed and was real worried I'd have to do it all again since there's nothing to notarize on this paper I finally got back from the CA DOJ. This is such good news. Thanks for writing back so quick!

You won't have to get it notarized, but I'd assume you would have to get it apostilled since its a new CBC. In California, if a document is issued by the state, then you don't have to get it notarized before getting it apostilled. With the CBC, you just have to tell them what its for and that it needs to get apostilled. They should then give you a letter with an original signature and seal.

I asked Immigration the same question last week and was told that the CBC is valid for 6 months. They can be reached at 02-1345. When I had a problem with misinformation earlier in the year at a local immigration office, a simple phone call from "1345" fixed it very quickly.

i got the same thing from california doj (no signature), got it notarized, and the apostille... it was a success with immigration.

I just got my CBC in California too and i am in the same situation. I did not have a signature with mine as well. It just says no record. I am going to call DOJ and get that cover letter.

They should just send that cover letter to begin with.
