Hi there guys, Im just wondering if anyone can offer a little bit of advice about lors (letter of release). I have a number of questions that I can't find conclusive answers to, and I am really in need of a little help. Well I guess the easiest thing to do would be to explain my situation and then go from there. . .
So I worked my final day at my hagwon last Friday (1 week ago). I had been there for 8 months but I decided that I wanted to leave- I told them this and they found a replacement who could start 2 weeks after I gave my notice in. I was a bit pissed when they said they wanted me to leave after only 2 weeks but I did not want to argue about it (was not even sure I had a case to make). Anyways so I left the hagwon last Friday- but I want to continue working in Korea and believe that I need a letter of release if I want to find a new position without leaving Korea.
Unfortunately the director now wants to play hardball with me- I think out of spite and I am not sure whether or not she will give me a letter of release. I sort of feel like I am in a state of limbo now as I am not sure where I stand with regards to my visa. This is because I do not know if they director has cancelled my visa..
Q1. Can the director cancel my visa without giving my a letter of release?
Q2. Is it illegal for the director not to give me a letter of release? (I know this sounds like a bit of a stupid question but I have read this in various forums).
Q3. What are the advantages and disadvantages, for the director, in not giving me the letter of release?
Q4. Is has been one week since I worked my last day- does this mean that I have to leave Korea within one week?
Also I'd love to hear any suggestions as to what steps you think I should be making now!
Sorry if this post seems a little confused- but that is how I feel at the moment!
Thanks in advance! |

1) yes.
2) no - they are under NO legal obligation to give you a LOR or release you from your contract.
3) make your life miserable and force you to do a visa run and complicate your gaining employment elsewhere.
4) It means you have 7 more days to inform immigration of your change in employment status (material change to your status of sojourn). They will determine when you need to leave Korea. Usually they allow 30 days after your last day of employment and mark your ARC accordingly.
If you do NOT go to immigration you have 14 days from your last day of work to leave Korea .

Thanks very much for your response. With respect to your answer to question 4- if I do go to immigration and do this will it mean that my visa is cancelled. You see I want to work in Korea again as soon as possible and have been led to believe that I might not be able to return here to work without the LOR even if I do leave the country and return- is this correct?
Thanks! |

Yes, inform them that you have quit. They MAY cancel your visa so you can begin the application process again, they may not.
They may require you to actually LEAVE Korea to cancel your status. (leave, hand in your ARC as you pass through passport control. This cancels your visa).
You then return, find a new job, process the visa confirmation number and do your visa run.
Cheapest way to do your out-and-back is to either find a discount flight to anywhere and return or take the boat to Japan.
Out and return on the same day is acceptable or you can spend a few days on the beach to unwind and then begin again.
Look at some of Cathay Pacific visit Hong Kong Now packages (air/hotel from 450k won).
