Is it legal for my employer to keep my diploma?

I'm having a slight disagreement with my employer. She says it's legal for her to keep my original diploma. As far as I know (and I've been working in Korea for a few years now) this is absolutely false. So, just to prove my point - is it illegal?

Just ring your embassy and get them to give her a friendly chat for a minute, that should sort her out.

Yes! They should keep your diploma and passport. They should also keep your first month pay. What do you think? They should just trust some foreigner?

Funny..but when I asked for it back, I believe those were her exact words: "But how can I trust you?"

She's a nice enough woman and all. It's just she's never had a foreign employee before, and doesn't know what she's doing, so she listens to other hogwan owners in the area.

Or as a security deposit.

I had my degree held at my last hagwon so i just rang my embassy at the hagwon, asked them very nicely to speak to my director about my diploma and my rights to have it, they talked to him for 30 seconds and got it back.

I'm amazed!! Truly amazed!! I haven't found the embassy helpful at all in dealings with them here or in Madrid.
