As discussed in this article, the white firefighters in question have been ruled in favor of. Given the attention this case got on the board sometime ago, it may be of interest.

Personally, I agree with the court's latest ruling; the mere fact that in a very limited sample pool minorities did not perform well is insufficient on its own to constitute discrimination, and realistically it would be hard to create a meaningful written exam such that it somehow favored whites. It's good to see the case has turned out this way.

Of course it didn't get much play here just as the mainstream (liberal) media has underreported the decision. Had the ruling gone against the firefighters, it would have received lots of air time.

One of the litigants is Hispanic, but that rarely gets pointed out in the press. Moreover, the firefighter who earned the top score, although White, is also dyslexic and hired a private tutor experienced with teaching those with disabilities to prepare for the test. Most of the Black firefighters admitted to not studying as much or at all.

David Souter sided with the losing side, not surprisingly. He turned out to be a huge disappointment for President H. W. Bush, who nominated him to the bench.

The cracks in the wall of Affirmative Action are growing. Even increasing numbers of minorities are questioning the direction it has headed in recent decades (see Pew Research Center online for a recent poll).

America is going to become more and more unmanageable as time passes. The Democrats are obsessed with equality of outcome for blue collar jobs yet the reality is that different groups preform at different levels. East Asians blow whites out of the water in a wide basket of socio-economic measures. So do whites for Hispanics and Hispanics for Blacks. There is no good future on this path.

I can see some countries which used to have small groups of minorities now having large number of ethnic groups and basically white people policing, fighting fires etc for them.

It doesn't have to be this way. Pluto a while back posted a great lecture at CATO about immigration and such. The tagline was "keep the immigrants and deport the Columbia faculty". I agree. Government made legal slavery, then Jim Crow, then segregation and the war on drugs. It is and has been government, all along, that is the single largest barrier to actual reconciliation between groups. Now, government is going to reverse this by meddling "positively"? No, I doubt it. This is just pissing off whites and will create a "white solidarity" over time. This is happening in Europe now.

I think that is hyperbole. There are tens upon tens of millions of white Americans who live a fine life, unmolested from the concerns you've raised above. My primary concern is that the state exaggerates and makes solid group identities.
