I have been in korea for 1 1/2 month, it is not working out with the school. So i gave them a 60 day notice. My head teacher said that i have to give her the ticket price back which she paid for my flight. The thing is it is not in my contract. I have also talked with another recruiter and they said i need to arrange my documents again and than we will get me a new job. He also said i can call Ministry of Labor and that i do not have to pay for my ticket. Advise? |

It is standard that if you don't work for 6 months the price of the one way ticket is to be reimbursed. I would check your contract very carefully, it is probably in there. I have never seen a contract that didn't have it in it.
Even if it isn't in it, I think that it is pretty crappy for you to make someone else pay for your ticket and not complete your contract. The recruiter will also lose their fees. I am surprised that they are still working with you. Usually if you quit so soon into the contract it looks bad for them also. Not that I really care about recruiters. I never use them.
Just pay back for your ticket, it is the mature thing to do. |

No, you've been here 6 weeks. Unless your boss has done something illegal, they won't do anything. You can go ahead and wait until you get your last check, which, guaranteed, will be sans the price of your ticket. After that, you'll need a ticket home or a ticket onward, you might not be able to teach here for a while until your original E-2 expires, depending on your circumstances. If you're hell-bent on Asia, you might try finding a job on-spec in Vietnam or Cambodia.
Why are you leaving? If Korea isn't your thing, don't come running back like a battered wife. Think about your options. |

As has been said, it's pretty standard if you leave before 6 months you refund your ticket over here, it is fair enough, the ticket is part of their overall investment in having a teacher here. |

if you can't/don't want to, then your next school, provided you get a release letter, may be willing to pay for the ticket. |

The OP doesn't need a release letter, go to immigration and tell them you quit because it's not working out, ask for an exit notice(Immigration usually sends these out to your address), you can ask them to give it to you in person. You shouldn't plan on paying for the plane ticket see how that goes. If they pay you fairly for your last month then you decide since it isn't on the contract. Immigration will give you a 30 day exit notice, find another job here if you want/can, have proper or necessary documents, be nice to Immigration, they might cut you a break on future required documents. During the 30 days find a job and if Immigration requires, go to Japan or another country to do visa run before the 30 days expires.
One more thing, did you send a 30 resignation notice to your employer by e-mail and C.C. yourself which is proof that you did so? If not, do it and finish your 30 days if you can/must. |

This is very common with the airfare being returned. It might not be in the contract but unless you are going home for good, you NEED them to cancel your visa or you can't get a new job!!!
So pay back the airfare and get your new school to give you airfare money!
Then your current school will not be pissed and you will not get shafted!
How easy is that? |

You also need 1 unopened transcript + your university diploma as you can't transfer your current visa. You will need to apply for a new visa so everything again except for a criminal record check as you haven't left Korea yet. |

You better check with the immigration office that with an exit letter, you can get a new E-2 Visa right away. My understanding is that this will get you out of your contract and leaving Korea but you won't be able to apply for a new E-2 visa until the current one expires at the end of 1 year. Otherwise, you will need the school to cancel your work visa to apply for a new visa before the 1 year is up. My friend had this happen and couldn't get a new E-2 visa as his school didn't cancel the E-2 visa. So make sure you have this covered!!!!
And Good luck getting paid and then reimbursing them for a ticket. No way they will pay you in full on your last month if you leave early! They will just deduct the airfare money from your last pay! |
