This is my first contract offer after applying to recruiters, etc in the last 24 hours. I'm so new it hurts. Please let me know what you think. I thought US citizens didn't pay tax for 2 years. I'm guessing this contract is below average.

About me:

1 year tutoring ESL and have some volunteer time with children in a boys home. My BA is Urban Studies: Community development and Housing. I have no cert and have had a 3 US credit hour ESL course.

Party A is the school, I would be Party B

1. Contract period ( 계약 기간 )
1) The period of this contract will be starting from __________________ and will be terminated on the ___________________.
2) Party B must inform party A of whether to renew the contract or not two months prior to the end of the contract, and the contract may be renewed at that time by mutual agreement.

2. Salary ( 월 급 )
1) Party A will pay a monthly salary of _________million won (Korean currency) to Party B.
2) A tax of about 3~5% will be paid to the Korean Government. ( Currently 3.3% )
3) Over time rate for each hour will be 20,000won.
4) Salary will be calculated from the day you teach not included orientation day
5) Completion Bonus: Upon the completion of your contract Party B will be given 2.1 million won as a � completion bonus�.

∙ 3. Pension and Tax ( 연금/세금 )
1) Party B will have Korean Income Tax deducted from the salary. ( Currently 3.3% )
2) Pension 4.5% of Party B�s income will be deducted from the salary to contribute National pension. 4.5% of Party B�s income will be added by Party A in order to contribute 9% of Party B�s pension. Party B can refund it when they finish their work in Korea. ( Total 9% of Party B�s pension )

∙ 4. Health Insurance
1) If the Party B wants to purchase a health and accident policy in Korea, premium 50% will be paid by Party A and 50% will be paid by Party B.

5. Working Hours ( 근무 시간 )
1) Party B will work at most up to 30hours from Monday to Friday (N.B. : class preparation time is not included, Only teaching time will be calculated except break time, lunch time).
2) One Hour means 60 Minutes. Kindergarten classes are only 40 minutes and Elementary classes are 45 minutes. So One hour does NOT mean per class but literally 60 minutes.
3) Classes and teaching will be scheduled in accordance with the needs of Party A.
4) Party B shall provide assistance to ALL the field trips for the students attending Little Campus.
5)Party B should keep track of the schedule changes and upcoming events. Even if the Party A or the Educational Administrator fails to notify the Party B. The Party B is responsible for the changes and being present at the events.
6) Party B should be fully prepared to conduct an educational lesson in class.
7) Party B should be in the teacher�s room at least 30 minutes prior to his/her first class.
Cool Party B must attend willingly to all events coordinated by Party A. (Presentation/Graduation/Entrance Ceremony/Halloween Day/ Children�s Day/ Field Trips(even if it�s on Saturdays) etc. )
9) Party B has to do phone teaching, it is also one of our curriculums, and it should be included in working hours.
10) Party B should stay at the school until school finishes even if you don�t have any classes.


6. Accommodation ( 숙 소 )
1) Party A will provide an apartment or flat (a person has one room) and will take responsibility for normal maintenance (repairs, etc.). Party A will provide a bed, a closet, gas stove, refrigerator and, kitchen utensils etc.
2) The tenant, including party B, will be responsible for paying utilities, such as for the gas, electricity, telephone bills, internet fee, water fee, etc.
3) Upon first arrival in Korea, it may be necessary for the teacher to stay in a motel temporarily before his/her permanent apartment is available.
4) For any damages he/she may cause or for the failure to pay his/her utilities while living in the house accommodated by Party A. Party B has to deposit money 200,000won. This deposit will be paid or wired to the account of Party B after one month when he/she moved out from the apartment.
5) Tenant fee is 80,000 won per month.

7. Holidays ( 휴 일 )
1) During the school year, there are many National holidays. There are also 5 paid vacation days in the Summer (July) of 2010 and 5 paid days (during the Christmas and
Korean New Year`s day) in the Winter.
2) Party A is not responsible for the vacation days occurring outside of the contracted period for Party B.


8. Party A�s Obligations ( 고용주의 의무 )
1) Party A will introduce to Party B, the Party A�s school policies and regulations concerning work conditions.
2) Party A will provide Party B necessary working and living conditions.
3) Party A will provide all textbooks and other teaching materials.
4) Party A will help Party B as best as possible with any problems, including personal difficulties in living in Korea.
5) Party A will provide lunch from Monday to Friday.


9. Party B�s Obligations ( 강사의 의무 )
1) Party B shall observe Party A�s school policies and regulations concerning teachers and shall accept Party A�s arrangement, direction, supervision and evaluation in regard to his/her work.
2) Party B is not allowed to work for any other organization including private tutoring without party A�s prior consent.
3) Korean law stipulates that no full-time instructor may work at two or more institutions at the same time. Failure to observe this regulation will result in immediate dismissal.
4) Without Party A�s consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.
5) Party B is responsible for the implementation of the school�s curriculum, grading and evaluation, and attending occasional teachers� meetings.
6) Party B must behave in a professional manner during class or when socializing with students after class.
7) Party B can be required to interview new students and evaluate their placement level.
Cool Party B shall not be absent without Party A�s permission, with 1 day in advance notice.
9) If Party B is more than 10 minutes late without notification, one hour rate of payment may be deducted and if one hour missed, one day deducted. The notification should be made by Party B one hour prior to class.
10) Party B shall respect the Korean people�s moral standards and customs.
11) Party B shall not sexually harass the students in his/her care.
12) No form of physical punishment must be used by Party B.
13) Party B must follow Party A�s teaching methodology.
14) Party B shall also respect their co-teacher. (No sexual or verbal harassment is allowed.)
15) Party B has responsibility to teach for absence of other foreigner teacher, if the working hour is beyond the contracted hours of the Party B, over time fee will be given.
16) Party B has to give documents including diploma to Party A and those documents won�t be returned to Party B until he/she goes back to his/her country.
17) Party B should keep his/her desk tidy in the teacher�s room.
1Cool Party B should be dressed professionally and is not allowed to wear inappropriate clothing such as, training suit, sandals, spaghetti strap tank tops, and extreme skin revealing clothes.
19) Party B is responsible for reporting the following students who seems sick, struggling with the class, not suitable for that level of English and/or causing a fight in class to the front desk or their supervisor as soon as possible.

10.Resignation ( 사 직 )
1) In case of Party B�s resignation, which must be notified at least two months in advance, the contract between Party A and Party B will become null and void. Accordingly Party B�s salary will be paid up to the date of party B�s resignation.
2) In case of party B�s resignation without notice before two months, Party A is not obligated to pay the salary for the month.
And Party B will pay utilities for two months.
3) If the Party B wants to leave before his/her contract is over, the Party A will not provide the completion bonus, and return airfare fee. Also the airfare paid for the Party B�s arrival to Korea will be deducted from the paycheck.
∙11. Dismissal ( 해 고 )

1) Party A will have the right to dismiss Party B for unwillingness or inability to meet conditions of employment as set out under this agreement, including neglect of duties. Neglect of duties might consist of not fully being prepared for classes, frequently spending time playing other activities other than educational activities, not putting in 100% effort into teaching each class, and/or parents complaining due to all of the above.
2) Prior to any such dismissal, Party B will be warned of dissatisfaction with performance or conduct and will be afforded an appropriate period in which to improve their behavior. Warning will be only given 3 times.
3) Party A will have the right to dismiss Party B for any conducts seriously jeopardizing the students or staff person, of criminal activity. For instance, Party A has the right under this agreement to execute immediate dismissal and for frequent neglect of duties under this agreement, including but not limited to, frequent absences warning nor time for remedy need be allotted.
4) Party A will have the right to terminate Party B from the place of Employment for frequently being late for class, for a manifest inability to perform the duties or meet the conditions stated in this agreement., or for a blatant disregard of the instructions, directions or discipline of the Party A or the Supervisor.
5) If the Party B is terminated, the Party A will not provide a return airfare, severance payment, completion bonus and their deposit. In addition, if the employee is terminated, the Party A will deduct from the Party B�s last paycheck for the cost of the Party B�s airfare that was paid for the Party B�s arrival to Korea. If the Party B decides not to complete his/her contract before completing six (6) months of the period of employment, the Party A will deduct from the Party B�s last paycheck the cost of the Party B�s airfare that was paid for the Party B�s arrival to Korea and forfeit the return airfare and deposit.
6) Pay period begins on the first day and ends on the last day of each month. The salary is payable on the 10th of the month following each pay period. On the last month of the contract the salary is to be paid on the last day of the contract.

12. Revision, Cancellation and Termination of the Contract (계약의 수정 및 종료)

1) Both parties should abide by the contract and must refrain from revising, canceling, or terminating the contract without mutual consent.
2) This contract may be renewed upon agreement between Party A and Party B three months prior to its expiration; otherwise, Party B will just finish out the completion of the original contract.
The undersigned agrees to the terms stated above in this contract and for future reference, each party is to keep a copy of this contract.

2) A tax of about 3~5% will be paid to the Korean Government. ( Currently 3.3% ) The tax rate might change because of a recent tax law change. Not too sure how it will affect the tax rate.
3) Over time rate for each hour will be 20,000won.
4) Salary will be calculated from the day you teach not included orientation day
5) Completion Bonus: Upon the completion of your contract Party B will be given 2.1 million won as a � completion bonus�. This should be equal to one month's pay. So if your monthly pay is 2.1 then it's good.

∙ 3. Pension and Tax ( 연금/세금 )
1) Party B will have Korean Income Tax deducted from the salary. ( Currently 3.3% )
2) Pension 4.5% of Party B�s income will be deducted from the salary to contribute National pension. 4.5% of Party B�s income will be added by Party A in order to contribute 9% of Party B�s pension. Party B can refund it when they finish their work in Korea. ( Total 9% of Party B�s pension )

1) Party B will work at most up to 30hours from Monday to Friday (N.B. : class preparation time is not included, Only teaching time will be calculated except break time, lunch time).
2) One Hour means 60 Minutes. Kindergarten classes are only 40 minutes and Elementary classes are 45 minutes. So One hour does NOT mean per class but literally 60 minutes. Most jobs go by the rule where one class equals one hour. You'll end up teaching a lot of classes.
3) Classes and teaching will be scheduled in accordance with the needs of Party A. They should give you the working hours. Being this vague, you can end up getting split shifts.
4) Party B shall provide assistance to ALL the field trips for the students attending Little Campus. Don't like this. Personally I wouldn't mind if it was once or twice a year, but if its more frequent, it should be paid.
5)Party B should keep track of the schedule changes and upcoming events. Even if the Party A or the Educational Administrator fails to notify the Party B. The Party B is responsible for the changes and being present at the events. This is unreasonable, unless notices are given to you, how do they expect you to know of the changes.
6) Party B should be fully prepared to conduct an educational lesson in class.
7) Party B should be in the teacher�s room at least 30 minutes prior to his/her first class.
Cool Party B must attend willingly to all events coordinated by Party A. (Presentation/Graduation/Entrance Ceremony/Halloween Day/ Children�s Day/ Field Trips(even if it�s on Saturdays) etc. ) Again, if these events are frequent, I would ask for overtime.
9) Party B has to do phone teaching, it is also one of our curriculums, and it should be included in working hours.
10) Party B should stay at the school until school finishes even if you don�t have any classes. Again, you should get the working hours in the contract, as it is you could be at school all day.

Big red flag, you shouldn't give any documents to the school to hold on to while you work there. If they ask for this then they probably had runners in the past.

1) Party B shall observe Party A�s school policies and regulations concerning teachers and shall accept Party A�s arrangement, direction, supervision and evaluation in regard to his/her work.
2) Party B is not allowed to work for any other organization including private tutoring without party A�s prior consent.
3) Korean law stipulates that no full-time instructor may work at two or more institutions at the same time. Failure to observe this regulation will result in immediate dismissal.
4) Without Party A�s consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.
5) Party B is responsible for the implementation of the school�s curriculum, grading and evaluation, and attending occasional teachers� meetings.
6) Party B must behave in a professional manner during class or when socializing with students after class.
7) Party B can be required to interview new students and evaluate their placement level.
Cool Party B shall not be absent without Party A�s permission, with 1 day in advance notice.
9) If Party B is more than 10 minutes late without notification, one hour rate of payment may be deducted and if one hour missed, one day deducted. The notification should be made by Party B one hour prior to class.
10) Party B shall respect the Korean people�s moral standards and customs.
11) Party B shall not sexually harass the students in his/her care.
12) No form of physical punishment must be used by Party B.
13) Party B must follow Party A�s teaching methodology.
14) Party B shall also respect their co-teacher. (No sexual or verbal harassment is allowed.)
15) Party B has responsibility to teach for absence of other foreigner teacher, if the working hour is beyond the contracted hours of the Party B, over time fee will be given.
16) Party B has to give documents including diploma to Party A and those documents won�t be returned to Party B until he/she goes back to his/her country.
17) Party B should keep his/her desk tidy in the teacher�s room.
1Cool Party B should be dressed professionally and is not allowed to wear inappropriate clothing such as, training suit, sandals, spaghetti strap tank tops, and extreme skin revealing clothes.
19) Party B is responsible for reporting the following students who seems sick, struggling with the class, not suitable for that level of English and/or causing a fight in class to the front desk or their supervisor as soon as possible.

10.Resignation ( 사 직 )
1) In case of Party B�s resignation, which must be notified at least two months in advance, the contract between Party A and Party B will become null and void. Accordingly Party B�s salary will be paid up to the date of party B�s resignation.
2) In case of party B�s resignation without notice before two months, Party A is not obligated to pay the salary for the month.
And Party B will pay utilities for two months.
3) If the Party B wants to leave before his/her contract is over, the Party A will not provide the completion bonus, and return airfare fee. Also the airfare paid for the Party B�s arrival to Korea will be deducted from the paycheck.
∙11. Dismissal ( 해 고 )

1) Party A will have the right to dismiss Party B for unwillingness or inability to meet conditions of employment as set out under this agreement, including neglect of duties. Neglect of duties might consist of not fully being prepared for classes, frequently spending time playing other activities other than educational activities, not putting in 100% effort into teaching each class, and/or parents complaining due to all of the above.
2) Prior to any such dismissal, Party B will be warned of dissatisfaction with performance or conduct and will be afforded an appropriate period in which to improve their behavior. Warning will be only given 3 times.
3) Party A will have the right to dismiss Party B for any conducts seriously jeopardizing the students or staff person, of criminal activity. For instance, Party A has the right under this agreement to execute immediate dismissal and for frequent neglect of duties under this agreement, including but not limited to, frequent absences warning nor time for remedy need be allotted.
4) Party A will have the right to terminate Party B from the place of Employment for frequently being late for class, for a manifest inability to perform the duties or meet the conditions stated in this agreement., or for a blatant disregard of the instructions, directions or discipline of the Party A or the Supervisor.
5) If the Party B is terminated, the Party A will not provide a return airfare, severance payment, completion bonus and their deposit. In addition, if the employee is terminated, the Party A will deduct from the Party B�s last paycheck for the cost of the Party B�s airfare that was paid for the Party B�s arrival to Korea. If the Party B decides not to complete his/her contract before completing six (6) months of the period of employment, the Party A will deduct from the Party B�s last paycheck the cost of the Party B�s airfare that was paid for the Party B�s arrival to Korea and forfeit the return airfare and deposit.
6) Pay period begins on the first day and ends on the last day of each month. The salary is payable on the 10th of the month following each pay period. On the last month of the contract the salary is to be paid on the last day of the contract.

12. Revision, Cancellation and Termination of the Contract (계약의 수정 및 종료)

1) Both parties should abide by the contract and must refrain from revising, canceling, or terminating the contract without mutual consent.
2) This contract may be renewed upon agreement between Party A and Party B three months prior to its expiration; otherwise, Party B will just finish out the completion of the original contract.
The undersigned agrees to the terms stated above in this contract and for future reference, each party is to keep a copy of this contract.

Yes this is what they sent me. It was forwarded through a recruiting agency.

Bah, I meant to post this in the contract post. whoops.
