1. The immegration center
You are supposed to be in Cheonan immegration center until January 23th(Wednesday).
If you do not, you are departed Korea by the force.
2. The house
You have to move the house until today. Mr lee will deduct 30,000won per a day from your money.
Whatever you go or not, the house will be locked.
3. Overtime charge
If you talk about your overtime charge again, Mr.Lee will ask you the loss by you - the visarun cost, recruiting fee, the losing customer compensation money.
4. The meeting time with Mr.Lee
You can meet him after 10pm today. You have to make clear in the house and bring the key.
He will check it and pay you some money deducted the housing fee from 144,000won.
If you don't have time after 10pm, you can leave the key at school. He will check and pay you tomorrow. |
1. I contacted Kimmi on my last day due to the LB hearing asked for more time. They told me to come in on Tue to get more time.
2. The contract is "over" my last day of work was yesterday. What can he and cannot do?
3. OT - obviously, non of the latter are in the contract.
4. 10p? with a key? Note that said 144k is what he thinks he'll pay me for 2 weeks work...
PLEASE HELP! |

Can you provide some more background information?
It looks like the email is from the hokwon and they want you to leave the apartment and settle up with the final bills but they aren't giving you much time, 10:00pm today?
It sounds like you've been having some problems with this employer and will going through labour in the future? It might be a good idea to get a hotel room for a night or two, and leave the apartment, then turn in the key as they are asking as soon as you can. Settle up with them the next day; it sounds like they plan on soaking you for 30,000 for the night, then head to immigration to sort out the visa extensions. You can always move into a goshiwon which is a lot cheaper than a hotel while your sorting everything out with labour. |

Sorry, I have posted regards different parts.
I gave notice for the 31st. Filed a labor dispute since the ... is trying to soak me for money with illegal deductions for a variety of things.
He's tried to dock my pay so much, that I can't afford anywhere else. Even if I could, I have a wife and cat.
The ... decided that the work ends on the 16th. Probably because he's got a new teacher. Not the 30 days as the law says. [LB].
Now I am under a threat of being forcefully removed, this is with a current labor dispute in the process, regards the date, etc.
Of course, it may be to disuade me from going to the Tax Office, as I will if he doesn't pay up.
To get some legalities straight:
He can't dock pay at all, and there's the legal issue from before, and regards the 30k he's talking about. He can sue if he wants to.
The contract has no provision for exit from the apartment.
Does anyone know what can be done? |

Change the locks ...it will cost 30,000 won. Then he can't just come in the apartment. He can't legally move your things or you can call the police. It is against the law to move the other person's property out of the house. He can rant and scream all he wants but he is not stupid enough to actually do it...he will just make your life horrible until you move.
----- Why don't you have any safety money? Sometimes it pours (not rains) in Korea and you need that money to save your butt. Hold on and don't move your things out of the house until he pays you. I am not jokin g..he will never move it out if you say you will call the police. It is a serious crime (weird laws in Korea).
---I know it is a crime. I own an apartment and the renter didn't pay the monthly money. I had to sue him, to get permission ,to kick him out, from the court( took 3 months ). I had to hire moving men from the court house and pay the court officer a fee for them to come move his things out of the house. I had to pay for the storage space at the court house for his things. It was very hard to do this....CHANGE THE LOCKS and he is screwed. |

Settle down in the apartment for a long seige. Ianinilsan went through the same thing with his hagwon. He just hunkered down and refused to leave, all in the face of daily death threats and pounding on the door and shouting. No one evicted him. |

You must change the locks because the School owner has a set of keys to the apartment (they always do) and the owner of the apartment also has a set of keys. They do go in the apartment when you are not home (a lot). You must change the lock or the school owner will just open the door and come in to scream at you. It is illegal for them to do it and they can't stand outside the door and scream at you. Call the police when they come...the police will take tell them to go away. |

Yep, the school will be much more interested in getting the labor board matter resolved if you are still in the apartment. Move into a hotel/goshiwon and they most probably won't even show up at the labor board meetings. |

The director at my school lost part of his keys, (or so he says, but it seems believable knowing him) and then tried to say that he would keep the deadbolt key (the one that is missing from the 2nd set) and that i wouldn't need it. Right after stating that to be safe I should use both locks when i leave and all three locks when I am inside...
as for not paying your contract in full after he decides to drop the rest of the time you would work, he can't legally do that. If he doesn't give you 30 days notice, he CAN cut the days of the contract BUT he is legally obligated to pay at least 30days.
yes, change the locks and if you have cash and can order take out or grocery delivery, do so |

I happen to think that there's a lack of blow by blows for the BS that employers do, so it's less of a story/conversation format, and more of a how to;
The threat was EMAILED at 2p.
1) I went online and searched Dave's "Eviction." Iaminilsan's story popped up.
2) I called the lawyer [The Bar in Seoul, has an English translator on Monday, if anyone needs legal advice] and forwarded the Email to him.
3) I called the Labor Board, where I was assigned a case worker, since an arbitration meeting was supposed to take place next week, that was not done yet.
4) I went over to Lotte, and for 28k won got a replacement lock and installed it.
Today I am going with the Email [yes, he's dumb enough to put it on record] to the Labor Board, to talk with the case worker. I am hopeful that a stern call from her would suffice, and he'll pay up.
My wife summed this fool's behavior this way: "A lier will always assume that you too are lying to them." I think that he believes I only said that I would go the labor board, or KImmi, or the tax office. You'd figure after he was reamed by the Pension office he'd learn not to screw with me. |

Ignoring the fact that Labor can do nothing to force the school to do anything, by staying in the apartment, you have more power than Labor. Use it in the negotiations (eg "Pay me this, this amd don't deduct this, and sign a promisory note with your dojang/thumbprint THEN I'll move out")
That's the only way you'll get anything in the short time you have left here. |

I agree. You being in the apartment, not budging, is a bigger problem for him than simply paying you to go away. |
