This is in reference to my EPIK contract, Article 14.
Article 14 (Paid Leave) ① Employee shall be entitled to a vacation period of a total of twenty-one (21) calendar days during the Term of the Employment set forth in Article 5 hereof. Employees working in a school system shall have vacation for ten (10) calendar days during the summer and eleven (11) calendar days during the winter recess respectively
I was under the assumption that I got 21 business days vacation, but the contract seems to imply that the 21 days is inclusive of weekends and holidays.
In Korean:
제14조 (유급휴가) ① 고용자는 피고용자에게 제5조에 규정한 고용기간동안 21일(주말, 공휴일 포함...
I think "주말, 공휴일 포함" means that weekends and holidays are included.
I insisted that they weren't included and as a result am getting full vacation days. However, could the school or POE insist that they are included during next vacation? For my next contract, should I have it changed?
If something similar has occurred to you, what did you do? |

Normally it's only hagwons that try to say that national holidays are included in your holidays. As far as I know, all national holidays are added onto your 21 days vacation. As for the other thing, in the province I'm in there was a meeting in November/December last year where they outlined the contract changes for this year's March intake and they had changed the wording from "calendar days" to "working days". I thought that the changes would have been nationwide, but I could be wrong. |

I know that in past GEPIK contracts the "holidays" were exclusive of weekends and/or red days
BUT
the 2 week renewal break DID include holidays and weekends.
From the looks of the partial clause you included that may no longer be the case OR someone has changed your contract from the original that EPIK used to use. |

It will depend on your school unless the board of education decide to be tossers about it.
I think the EPIK teacher at my school got more than 21 calendar days but not 21 working days. The contract I signed in September has 18 working days vacation, split into 10 winter, 8 summer. |

Unfortunately because of the vagueness of your contract it can go either way. My contract was the same last year, and when I went on winter vacation they counted New Years Day and the following weekend as part of my 21 days. My boyfriends school, on the other hand, was cool about it and he got a whole extra 3 days off that I didn't get. From what my provincial office told me if you take a vacation and a weekend comes in the middle of that time then those days can be counted against you if your school so chooses! I hope you end up at a generous school ! |
