Hey there.
So I'm leaving Korea soon and my Korean wife will be coming with me.
We applied for a settlement visa once and we were refused.
Right now our application is with the embassy for a Family Visitor visa.
Problem is we've booked tickets for the end of this month, if the Visa isn't ready or rejected by then I'll have to fly out alone.
I recently found out Korea isn't a country which requires a visa to enter the UK.
My question is, since she's already applied, already applying, would it cause problems if she just came into UK without a Visa?
Any help would be greatly appreciated. |

I took my Korean lady to the UK and Spain last month. She was given a 90 day tourist visa each time she entered (3 times in a month). They quizzed her a bit at passport control, but no real hassle. She was there purely for tourism purposes though, remember that. |

If she's applied for a spousal visa then she cannot enter the country during the application process. The application shouldn't be rejected unless you are unable to show that you have enough funds to support your wife. |

Let's say she failed her application.
Can she come without a visa and have an interview in the UK and come in? |

She's Korean and thus doesn't need a visa to visit the country as a tourist. I believe that Koreans are allowed to stay for six months in the UK as tourists. If you were turned down for a spousal visa however then her actually being in the UK will not ensure that this time you will be successful. You cannot switch to a spousal visa whilst in the UK as a tourist, and she would have to go back to Korea before making a fresh application.
I don't know what your financial situation is, but providing you two can show around �10 - 20k in the bank then you could always try exercising your treaty rights and moving to another EU country. If you did this then you can apply for a family settlement permit for your wife once there......in Germany, for instance, your wife could come as a tourist and then apply for the settlement permit in country. There are no language requirements your wife would need to fulfill in order to get these permits (unless you happen to have dual nationality with the UK and the country in question) although obviously it would help to learn the local language. The Netherlands would be the obvious choice, being that English is widely spoken and the economy doing better than most other Eurozone countries at the moment.
Alternatively, there are always the working holiday visas for places like New Zealand and Canada. If you have a little over $10k in the bank then you can apply for a Skilled Migrants Visa whilst you are still in Canada. Your Working Holiday Visa would be extended whilst you wait for Canadian immigration's decision. Your wife would be accepted on your application, or vice versa. Koreans and Brits under the age of 30 can apply for this visa. |

I'm sorry to read about the problems you are having, however what was the reason given that she failed to get the correct visa? because unless she or yourself is younger than 21 years old or neither of you have sufficient funds to support yourselves whilst here, then I don't understand why they refused her visa application..
And who books tickets before getting a visa? or atleast book flights well in advanced atleast  |
