Would appreciate some help guys. So here is the deal. I finished a public school contract (3 years) in late March. Went back home because I needed to see my family, and came back here on a tourist visa to look for a new job.
Found a new job, and submitted documents, but immigration won't accept them. Why? Because the background check is a copy. I was under the impression that if you haven't left korea for 90 days, you didn't need one.
Right, but they went all the way back to 2011-2012 where I left Korea for more than 90 days while I was applying to EPIK (I applied while in Korea). While I was finishing up my hagwon, I sent a copy of my background check to immigration, and was able to get a visa for EPIK while I was out of Korea.
So fine...I accept it....The school went to talk to immigration, and gave me the impression that they told them that they would "accommodate" us and allow me to "train" (aka work) at the hagwon until my background check comes in (at least 3 weeks with a channeler).
This is pretty illegal right? And I'm not so sure immigration would knowingly allow someone to do that.
I'm married to a Korean, and I am concerned about working illegally and then being deported leaving my wife here.

I'm pretty certain that everything comes down to the immigration officers digression. So while you may be in the right, it doesn't mean jack if the immigration officer says no. |

Yeah I've already accepted immigration's explanation. It's just the matter of "training" (working) at the hagwon while I wait on a new background check and them saying immigration is okay with it. |

Yeah what you describe sounds all messed up.
2 possible (maybe more but 2 simple ones)
A) You are married but still on E2: Less than 90 days out and you gave a CBC last year for the previous contract. = Do not need one for this one but you will for the next.
B) You are married and on F6: My question is why are you dealing with immigration at all? Go to the MOE with your flight info from your Gu/Dong office about your entrance and exit times to and from Korea with a Korean (takes 10 minutes at a Gu police office) CBC.
C) Other cause you sound like some qeird combination of A & B |

Was the background check a certified copy? Through from MOE. I think the problem is you were in the EPIK program. EPIK had you records and immigration never saw them. so the 90 days would be moot. So when you went to immigration they had nothing on record for you.
As to illegal you have been given a qausi pass by immigration. Just get the CRC and submit. You will likely be golden.
Through as other people ask why not go for your F6 visa. Things will be a bit easier. |

Yeah so everything seems resolved now. Visa number is being processed and basically whenever I get my CRC, I can just submit it to immigration because the immigration officer said they made a mistake or something.
As for the F6, we are working on that now. I was trying to find work ASAP though so I have to do the E2 in the meantime. I'll just change it to an F6 in a month or two. |
