If you're leaving the country the day after the ARC expires, do you need to get an extension from immigration or does the exit order eliminate the need? And how do you get an exit order? |

You need an extension. It can be done on-line or at your local immigration office. You need to do it MORE THAN 24 hours BEFORE your ARC expiry (in person) or 7 days prior if you are doing it on-line.
You need your ARC, passport and exit ticket.
Exit orders are for people who MUST leave (because of a material change in their status of sojourn) BEFORE their ARC expires.

Not relevant to departing (end of contract) the day after his ARC expires.

Everyone should know and remember this simple rule:
Look at the back of your ARC. You must leave Korea by midnight on the date on your ARC. Sure, sometimes people may get lucky and no fine and no record, or so we've heard. But, don't count on it.
If the date you plan on leaving is after the date on your ARC, or even if it's just going to be close - late on the same day, for example, get a free extension. Don't risk being fined or having an immigration violation. |

hi ttompatz,
i think you are the guy to ask.
i am on an E7. about 8 weeks ago my company refused to pay me so i quit. I then filed a complaint with a lawyer through the labor office to get my salary.
Since that time i have been offered a job to teach on an E2. i didnt tell immigration that i quit my previous job. i thought if i did they'd ask me to leave korea but i wanted to stay and fight for my salary.
So, tomorrow i will visit immi and ask for exit order, with 30 day stay, and hopefully my visa issuance number will come through.
Does it sound likely i will get exi order with no problem? If not, what should i do tomorrow?

+ Going to immigration is a good thing.
- You may or may not get an exit order.
- You are technically in an illegal position (more than 14 days since your change of status) and technically you are illegally in the country but it may very well be overlooked due to your extenuating circumstances (if you can verify to immigration that you have a labor case outstanding).
Be apologetic to the clerk at immigration for your violations (not reporting) and hope for the best.
worst case - told to leave ASAP but allowed to return on a new visa.
options:
Leave (hand in ARC on the way out), return as a tourist (same or next day) and process the E2 application, do a visa run then start work.
