I got a job offer for a better position than my current one. I told my employer weeks ago that I was searching, and why, to paraphrase his response, "We'd hate to see you go, but I wouldn't want to stop you from doing what is best for you."

The problem is that my current contract runs until Feb 2011. When I told my boss (via email) that I got a job offer and would like to resign he responded with a letter with the following points:

1. shame on you for not wanting to finish contract (although he knows that my unique opportunity will not be available half a year from now).
2. a summary of Korean visa law - my current school must accept my resignation for me to legally be allowed to work elsewhere
3. We will grant you the letter of release if you pay us 1.5 million "to find your replacement"

My question is: is this true and legal? what would you do in my position (trying to change from a dysfunctional school to a prestigious one)?

Has your school done anything illegal (pension, health insurance, etc)?

Just walk out at your convenience (the day after payday).
Catch a flight to Japan (or anywhere else that is cheap).
Hand in your ARC on the way out and inform them that you have indeed quit your job.

Return to Korea and begin the process for your new visa.

Any boss that request that YOU pay for finding the replacement won't pay you for the last 30 days if you give notice anyway so save yourself the grief.

Talk to the police and immigration, they have departments to deal with this stuff.
You might even get a reward for turning them in.

No, they don't and they (police and immigration) couldn't care less.

The employer is under NO OBLIGATION to supply a LOR.
The asking for 1.5 million to secure it is not nice but certainly not illegal.

Just quit, leave, return and begin again, older and wiser.

If you have a Korean speaking friend, ask them if they wouldn't mind being your reference from the old school.
