Quit or Be Fired because you are in the hospital

I just completed 8 months of employment at a well know chain hagwon. I became very ill recently and was taken by ambulance to the hospital. Doctors say I may be out in 4 or 5 days.

When I was admitted, I was told that my insurance was expired because my boss had not paid it.

My boss just came by to tell me I need to quit because I am not well enough to work and it a big inconvenience for her.

What approximate percentage should insurance pay for my hospital bill?

What are my rights?

Who can I contact?

What are my chance of getting:

Bill paid?
Ticket paid?
Partial Bonus?

It depends on what your contract says. HOw many sick days do you have written in?

She can not force you to quit, she can only tell you that she is giving you 30 days notice for letting you go.

However if you have no sick days worked into your contract you could technically be in violation of your contract ( not sure if the labor board agrees I dont know what they labor board rules in the case of emergency illness)

your rights in regards to partial severance, return airfare and getting your medical bills covered are NON-EXISTENT.

You clearly aren't/weren't on the NHIC so your medical bills would be 100% of cost.

NHIC normally covers about 50% of in hospital costs.

Partial bonus = severance and there is NO entitlement until you have completed a full year of employment (ergo - none paid).

Airfare is a contractual matter only unless it comes to the point where immigration is forced to deport you (then they chase your hakwon for the repatriation expense since they were your sponsor).

Good new is that she can't just fire you for being in hospital for a few days (even if there are NO sick days in your contract) and you do have rights in regards to an illegal dismissal (contact the labor board for this one). http://www.molab.go.kr/.

Then you will have a contractual fight over the medical bills and if you manage to get reinstated and complete your year you should then be entitled to your severance and airfare.

What if he just takes off and leaves the country.. will they come after him for the medical bills abroad?

Sorry to hear about your situation and hope that you recover without any further problems. I do have a few questions though:

Were you ever enrolled with the NHIC through this employer?
Did you receive a monthly pay stub that showed your deductions? If you did, was your employer deducting your share of the insurance after your
insurance had really expired? If so, I would definitely present this as
evidence to the labor board.

Do not quit! If you do, you lose all rights to petition Labor.

You state that you will only be out of work 4 or 5 days.

You have worked 8 months and only have four months to ago.

Instead of an inconvenience to your owner, have you considered your school has a replacement waiting in the wings and is trying to get you to quit so that they can skip paying your severance and providing a return airline ticket?

Pay the hospital bill. You have 8 months of and if your doctor clears you to continue working (the most important consideration is your health since you went to the hospital by ambulance) finish your contract and collect what's due.

The four months of additional salary will far outweigh your hospital bill.

Like most Asian hospitals - they won't let you out until it is paid.

IF you manage to escape then fleeing the country is an option. They won't pursue you after you return home. You won't be coming back to Korea to work afterward though.

I think that you're better off paying your bill and then "negotiate" with your boss. They have been doing something illegal by not signing you up for health insurance (and whatever else they "forgot" to do). You might get them to just reimburse you for the cost of the hospital. Then have them sign you up for the future.

They can't really fire you for it. Not for only 4-5 days. At most they could deduct something from your pay. But since they've done something else illegal (HI and pension) they probably don't want to draw too much attention to themselves.

They won't let you out? What if you're broke (like I will be ha ha)? That's pretty scary. How hard is it to escape? Maybe I'll pack a doctors jacket and stuff with me, in case I have to sneak out of a hospital. Do they wear a standard white jacket or?

Here's a link to an article regarding health insurance. It states that heath insurance is not required by law and that payments are shared by the employer and employee.
