I have recently arrived at my new school... brand spanken new! However, I was surprised to see that my apartment was a converted storage room INSIDE the school. My kitchen in an office kitchenette. My bathroom is shared with the public, and my shower is on an enclosed balcony. This deception was enough for me to ask for a release, no doubt...considering I made it very clear to him from the outset that living conditions are of paramount importance to me.
My new boss refuses to give me a release. He agreed to get me a new place, but its an old broken down crap-hole. He can't afford to furnish anymore than the basics(fridge, burner, bed, TV, washer), even though he lives in luxury.
I want out...!
My question is... can I void the contract if the company name of my school is different than the company name on the contract. The owner has closed his old school and started a new one...but the contract still bears the old name. The address on the contract is correct, however.
Anyone know if this contract is voidable???

Opne the window and insist to the director that you need the fresh air when you are showering.
That will get you moved pretty quick.
Release depends on what is stated in the contract. |

Sounds like a bad deal indeed...
However an appartment furnished with "fridge, burner, bed, TV, washer" is pretty much par for the course. It should not be a crap-hole however!
On the point of crap holes what do you consider a crap hole? |

You could move into a hotel and tell the director that he has 2 weeks to find you an apartment.
Then start messing with him. Start wearing a t-shirt to work every day with 'XXXX is too cheap to provide me with an apartment and makes me live in the school' written on the front. I'd pay to see the look on his face. |

That could be a crucial question, actually. It's not actually realistic to compare the place he gives you to live with the place he lives in. Hogwon accomodation is often dodgy. |

This reminds of the last time I ever tried to recruit a teacher. I got this poor guy over here from the states and got my million won, etc etc. Everything was fine until we discovered he had to live in the back of the boss's other business - a small kalbi restaurant. Not only that but another foreigner was also living there and they had to share a room seperated by a curtain. This poor teacher, naive as he was I guess, agreed anyway. I felt bad and encouraged the boss to get him a real apartment but he never did. The foreigner quit a month later on his pay day. The boss called me 100 times. I kept the recruiting fee and told him it was his fault the teacher had quit and I would have too had I lived in a noisy restaurant.
I lived in a couple of good places and a few bad ones. The set up I have now is the best. A brand new one room across from the school. Perfect, as I can run home anytime. Plus it's so clean and new! Everything works for a change.
The worst place was in Ulsan. An old sqaure one room with holes in the screens and a door that wouldn't lock. Cokroaches galore and relentless mogies. Trickling shower water...

I like the idea of the t-shirt.
I would check into a hotel and tell the guy he can pay the bill or get me a new place ASAP.
I might be tempted to even not shave until I got moved. |

I believe your contract has already been voided.
If the school you signed with has been closed then your contract is over.
The fact that your boss has opened a new school is besides the point.
Your contract is not with the new school.
In fact you might even find that you are in an illegal work situtation.
For clarification, if I were you I would direct your question to the efllaw guy over at the pusanweb.com forums or go straight to immigration. |

Go to immigration TODAY.
Or better yet, first thing Saturday morning. Be there by 10am.
Get answers fast, or you may find you are paying a fine on top of being out of a job.
Think it doesn't happen?

Okay as far as I know... if you prefer avoidance over confrontation... just go to Japan, sign up for a new tourist visa. Bing-bango. Your e-2 and contract are automatically cancelled. Unfortunately you'll have to go back to Japan again for another e-2 when you find another job but it certainly avoids the trouble of a release letter...
But I also agree with the other postings. Go to Immigration. Ask. Your honesty may buy you some points even if the government shows up at the hogwan and fines the Director for you working illegally... |

There seems to be no legal way out of the fine.

You do not have a contract. All documents must bear the same name. Old school gone, no valid contract. Talk to your boss, tell him that the contract is invalid and if he does not provide decent accomodation within 30 days, you are gone. All the other advice regarding immigration is very worthwhile and worth your time to research the legality of your current situation.  |

This might possibly be true if the school were operating under a legal entity such as a corporation, but probably not. If the school's name was simply a DBA for the owner, it wouldn't matter if he changed the school's name every day and twice on Sundays. |
