I lived in New York my whole life, till I transferred colleges in 2008 to the University of Iowa. Will I need criminal background checks from both states to obtain the E-2 visa?

Sorry but,

yes, no and maybe.

No, under the new rules you will be required to have a federal check done.

Yes, if you are applying to EPIK, they want one from each state you have lived in.

Maybe... the rules are changing and K-immi is known for being inconsistent in it's interpretation of its own rules.

I know that is NOT the answer you were looking for but realistically, get the FBI one done.

The writing is on the wall and it will be accepted in place of any state check anyway. You won't go wrong with it.

They will take one from whatever your CURRENT state of residency is, but you should go with a federal check to be safe with the new rules.

A federal check is superior in that it only shows serious misdemeanors on up that required you to get booked (fingerprinted at a minimum).

You want a federal, it's more accepted and much more likely to come out clean.

Also, I'm Iowa Alum. Iowa City ftw!

I thought the federal was only for people applying or renewing after Jan 1st, 2011. The CBC is only good for 6 months away, so whether you get state or federal, it is is worthless in 6 months anyway. At least, that is per one of my recruiters.
