On September 7, 2010 I will have been employed at a school for six months. I am leaving my job at this school and have secured employment elsewhere in Korea. I was hoping to transfer my E2 visa to a new employer and obtained a Letter of Release that is dated August 20, 2010. ( Date on letter not six months from March 7 issue date. ) Is this letter acceptable to immigration if submitted on September 7, 2010?
I spoke with my former recruiter and he informed me that the school is planning on cancelling my visa today or tomorrow. Can my original employer tell Immigration to hold off for a few days so I can transfer the visa to a different employer rather than go through the whole process again?
If not: I took a trip to Japan last weekend. Must I do so again if the visa is cancelled? What docs will I need to submit in order to apply for a new E2 visa? How long will issuance of a number take? ( How long will obtaining a notarization and/or apostille from the Korean government body take? Can it be done in one day if I show up with my new employer and stress the urgency of the matter? )
Am I permitted to work for the employer if they only employ one foreign teacher and my docs are being processed for the E2?
I wasn't counting on all of this and certainly wouldn't have taken a vacation if I knew that I wouldn't be getting back to work right away. Please help me out if you can! |

Get a new letter of release with the correct date. It is supposed to show your last day of employment - not necessarily your last day of work. Don't cancel that visa at all if you are planning on transferring. Get a letter of release for the correct date, your other documents and the documents from you new employer and get your ass down to immi to do the transfer.
Once a visa is cancelled it is gone - there is nothing left to transfer and you will need to apply for a completely new visa. |
