My friend has been working at her hagwon for 5 months and found a much better deal.
Anyhow...she was told that all she had to do was give her notice and give her ARC to immigration on the way out and she is released and can come back in and work at the new job the next day.
I told her this is bull and she needs a release letter as the first hagwon is her sponsor for the whole year so if she came back she couldn't work at the new hagwon without a release letter.
So am I right and does she need a release letter or is she right and can she just walk out and come back in and start a new job if she just gives them the ARC?? |

Yes, you are right. If she wants to work legally when she comes back, her next visa application will set off alarms at immigration if her first visa is still valid at that time and she has not been released from her contract. However, if she waits until her visa expires before she applies for a new job, she may get away with it. |

She doesn't want to wait. She wants to start 5 days later. |

Then she'll need to get a letter of release from her current employer, or convince Immigration that she shouldn't be held to her contract (in this case, very unlikely without much notice). |

That's true in theory, in practice a lot of schools employ people who haven't gotten a release letter by either having them work illegally or working a connection at/bribing immigration. But its definately better to get a release letter (which is what I'm doing) since it makes live easier for your new hagwon. |

The question to ask here, is whether or not her current school is releasing her from her contract? If they are, have her have them advise immigartion and cancel her E2 and when she leaves hand in her ARC and come back on a tourist until her new E2 is organised. If not, then she needs to give her 30 days notice and then leave and come back.  |
