I have been at my current hagwon for two months and after the end of November I'm being let go due to the small amount of students. My director is new so he decided that the school needed an extra foreign teacher (me) even though there are not many students. He has now realized that was stupid and is getting rid of me. I want to find a new job but I'm not sure how it works with the visa. My boss tells me it will be easy, but he is pretty clueless. Is it possible to just transfer my visa to a new job?

You need a Letter of Release. Then you can find another job using your current E-2 Visa.

No, the Letter of Release is only useful if you've worked 9 months on your current contract, then you can use the Letter of Release to transfer your visa. If you haven't worked 9 months, the Letter of Release is useless.

Sorry OP, you're going to have to start from scratch. Start getting your documents together now. Unless you're Canadian, your CBC should still be valid (most are good for 6 months), but check to see if you need a new one.

Just get the letter of release and you will be good to go. It happens a lot to people working in hagwons.

If the letter of release states that the school is suffering financially, and the boss agrees to go with you to immigration to explain that it wasn't your fault, things may work out in your favor. Give it a try. It couldn't hurt. I've got my fingers crossed for you!

Unless they've changed the rules in the past few months, Canadian CBC's are only good for 3 months. I don't know why.

I have been in a similar situation. Immigration said that in order to get a new job, we needed a whole NEW set of documents for the visa process. We were also told that the release letter is worthless if you have only been here for a couple of months. You need a new criminal check - it will take a while so get working on it now. We were told by our recruiter that some schools will still take you on if you can prove that you have already applied for the new criminal check. Good luck.

would the new CBC have to be from your home country or from Korea?

i ask, because say you've been in Korea for 5 months, your home country can't verify your background for that period. so would a Korean CBC suffice?

Whether or not you can use the LOR after only 3 months is really up to the individual immigration office that handles your case. You can give them a call and ask. They speak very good English.

From what I've heard (and experienced first hand) the commonly applied rule now is 6 months for a transfer (with a LOR). It used to be 9 but apparently it's almost always 6 months now. BUT if your school is going out of business, or suffering financially, and your current employer is willing to come with you to immigration to confirm this, then the immigration officer might allow a transfer with less than 6 months. I've heard plenty of cases of this happening.

Has to be from your home country. Haven't lived in my home country for nearly a decade, acquired another passport from another country as well. They don't care. It's got to be from the country where your "English" passport is from ie. one of the 7 English speaking countries.

What I still don't understand is why the OP would be required to provide another CBC, if he's already submitted one for his current job. If the OP wants to transfer his visa to another school and he remains in Korea, why on God's green earth would Kimmi require another CBC?

I wish someone would slap some sense into these imbeciles. First they bring out new visa regulations...and then they postpone them for a year... Rolling Eyes
