Need some advice.

My wife and I have been working in a Korean Hagwon for two years. We both receive pension. In the contract it states that in case of pregnancy the employee will refund 50% of the pension. Basically the half they payed.

My wife was pregnant but finished her contract. The day after her contract was finished her water broke. So technically she did not give birth during the pregnancy.

Do they have grounds to ask for this refund? It kinda seems like they don't have a case from my point of view. Any help would be very much appreciated!

Are they actually asking for it, as of right now?

What on earth? I mean, there's a lot of weirdness in contracts, but where did this come from? Can someone make any sense of it?

I THINK! What is happening is this.... If a person leaves a contract early like sickness or pregnancy the person has to pay back the pension of what the school paid in. This sounds illegal to me! Sounds like a typical money grab from a school.

Tell them that you will not be paying a penny until you have spoken to the pension office AND labor board about this. I'm fairly positive that may be illegal. As far as I know pregnancy does not allow either the employer or employee to opt out. That clause sounds like an illegal money grab. Definitely speak to the relevant authorities I suggested above before paying.
