Hello everyone!! I have an E-2 visa and am currently leaving a horrible school. I got an offer from a school with a much better reputation and I am very excited about starting.
My question is....how can I get my E-2 visa cancelled? The labor board told me once that my principal and I have to go to immigration together to cancel it. I have not worked at the school for over 30 days.
Does anyone have experience with leaving a school before the end of the contract? I don't want to make a mistake and jeopardize being able to get another E-2 visa. I want to make sure that I am 100% compliant with Korean law.

LOL TOO.
Man! Where to start. First off will your principal sign off on you leaving? I mean it is a horrible school as you say so that sort of says to me that the principal is bad, too by proxy. Ssomebody who is bad will likely not do you a favor.
Second, honestly I think their is a limit to transferring an E2 something like 9 months. So are you willing to wait eight months. Honestly I think you will have to leave the country. Do not listen to the labour board about immigration problems get you advice from the immigration department directly. So be prepared to go to Japan/another country. Leave your ARC card at the immigration booth at the airport, go have a rest and come back on a tourist visa. Even then I still think you might have to wait for you previous visa to expire meaning 11 months (I think I may wrong about this).
Third have you got the money to buy off the school. They likely just paid for your plane ticket, recruiters fee, and even spent time finding a teacher and you who they found want to leave less then a month in. Expect yelling, threats, and no pay check. So have you got an extra 3 million won or so. If you do not buy off /pay off the school you can expect problems ranging from blacklisting, other jobs falling thru, and bad name amongst schools.
Fourth, you have a new job available. Does the new school know of your problems. If not, do not expect them to help much or wait long for you. In their eyes, if your problems will take more then a couple of weeks and more that a million or two won expect them to move on and get a less troublesome hire. (in this market so much easier)
I laugh at you (LOL) because you are going to have problems. Still GOOD LUCK. Hopefully Ttompatz or someone else can give you the straight dope on the law.

your best bet is to go back to school, suck it up and work at least 6 months. That way you are not on the hook for any expenses and you can give plenty of notice. Otherwise, you are going to have a hard time. GL |

Bad news for you and more bad news for you.
You have not been there for 30 days yet so you do not have an ARC.
You probably have to repay airfare and any settlement that the school paid out on your behalf (contract issues).
You CANNOT transfer to another job. Your ONLY option is to quit and leave Korea to cancel your visa (unless by some strange stroke of luck your boss is willing to go with you (in person) to immigration and cancel it for you.)
Realistically, your ONLY option is to quit, leave Korea (tell the immigration office on the way out that you have quit and to cancel your visa).
Re-enter Korea and begin the visa process all over again from scratch (with NEW documents that meet the new requirements) with the new employer.
