I dont need a lecture here about copying materials from the Net. Here is the deal:
I was a part of a team to write test materials. The team included 4 writers and we produced about 500 pages.
When we finished, the Korean guy who hired us refused to pay. Said the materials were no good.
We took him to court for the payment. We found out that one of the writers took stuff from the Net. Of the 500 pages, the copied materials is about 30-40 pages.
I have asked several orgs but I cant seem to find out how the judge will view this. We have no case? Will get a partial payment? Any input would be appreciated. |

Hatcher, Define "team.
Did you actively work with the offending person?
-OR-
Were you just one of the four on the team that worked independently AND with no prior knowledge of the offending person's work?
If you collaborated with the offending person in any form, you will not be compensated and ARE liable for any and all statutory and compensatory damages, individually and collectively, should the copyright owner make a claim.
