Right now there are 12 (13 counting this one) threads related to criminal background checks on the first page of Dave's. It's getting kind of ridiculous.
Can we have one thread that is not a flame war and that just says there is no way of knowing if you will be issued an E2 with a hit on your CBC unless you apply? And sticky that bad boy.
It doesn't matter if it was J-Walking when you were 18, a DUI, or possession. You may or may not get an E2. Try getting it expunged. Don't commit crimes (or get caught) in the first place. Get a different visa if you really want to come here. Immigration does not have a set standard of who they will allow or deny. Some people with a DUI get in, some people get rejected. It is up to the discretion of the officer reviewing your application. There is no way of appealing to him/her.
Yes it is an inconvience to a very small portion of applicants. Good luck to you. |

I actually like hearing the specifics of each case. They always turn out to be good threads 
It spices up things here a bit on Dave's, and people get to vent and talk about their problems. |

I'm in the camp of the few that are potentially screwed by the new regulations.
I was arrested five years ago, but the charge was dismissed. Even with the disposition listed on my record, I fear that I won't be able to renew in 2012, or get a new job in 2011 if it comes to that, even though my school would definitely go to bat for me. Even should I eventually marry my K-girlfriend, I would still be required to produce a background check to work at a university or a public school on an F2 visa. It's really making me reconsider my long term plans.
I've been contacting everyone I can in the state govt where I was arrested, but no luck so far. It appears that my state absolutely does not expunge records. Extenuating circumstances be damned. The best they could do was update my FBI record. I guess that would be enough for most any employer--to see that the charge was dismissed. But not for k-immi. |

That's the next step. Although I'd obviously prefer not to have to go that route. I'd think there must be some provision in place. But perhaps it's not well known, or maybe the govt. doesn't want it to seem too accessible.
Do other countries that require a federal background check, like Japan, discern between arrests and convictions? |
