I've looked around and not found anything which matches my current situation.
I left Korea in January, fully intent upon returning at the end of February to resume my job at a Middle School. Unfortunately, my father, who has been sick throughout the year, turned out to be more sick than I had expected (he's suffering from Emphysema, an incurable lung disease.) Of course, not intending to leave, I didnt hand in my ARC.
As a result of this, I didn't return at the end of February, as I wanted to spend quality time with him.
I am worried that my school may blacklist me because of this, despite my having kept them informed of my father's situation throughout the year.
I wouldn't care, except that I left an amazing lady behind who I love very much.
What is my legal recourse? I would like to return sometime during the year, although if my father deteriorates, that may not happen. |

Were you mid-contract, or were you between contracts?
Did you give your school notice that you had decided to stay in your home country, or did you simply not return, and they had to figure it out from your absence?
If you were mid-contract, and gave your school no notice, other than not showing up, then I would think you had ticked some people off, and might have made the hakwon blacklist...but immigration does not check the online lists (at least, I have never heard of them doing so).
Even if you are on a hakwon blacklist, that would not prevent you from returning -- it may, at most, make it a bit tougher to find a job. Now, finding work in the same town could be a LOT tougher, as people tend to talk about things, but if you head back to a different area of the city, or a different city, I doubt you will have many problems. |

Family first, dude.
But I wouldn't go into too much detail when applying for a new school. A sick parent is often the excuse given by people that jump ship. |

I had signed a new contract, hence had got the extra 2 weeks vacation, making my time home a full month.
I lost out on my severance as I did not return, this doesn't worry me too much, but I m missing my lady much more than I expected, so would like to keep the door ajar for a return in the next few months. I am enjoying time home with my father, but my employment prospects here aside from tourism work are not huge! |

I kept them in the loop from the word go... I would hope I didn't tick them off, they kept asking me to return, I told them that my family had to come first, but it turns out the fly in the ointment may be the BOE.... can they stuff you up? |

IF you extended your contract (and your ARC) then you shot yourself in the foot.
Your visa would not have been canceled but you can pretty much be assured that your job was.
You may have to wait till your ARC expires before you can apply for a new E2.
If your ARC expired while you were away, then no worry. You just won't be returning to your old school (or POE if it was a public school).

Ttompatz,
That's exactly what I feared. Is there any way I can send the ARC back to Korea/Immigration and get it cancelled?
Also, does that affect my ability to enter on a tourist visa? I don't want to be hassled/ bothered. Later in the year, I do intend to return in some capacityy.... |

They would have been able to replace you in a week or so given the current job market.
Find out what has happened- either from your employer directly or from someone who works there.
if they do not want you back, you could fly here and cancel your visa personally, then look for a new job. |

The job has gone, that is cool and I have zero problem with it.
The issue lies in their lack of communication regarding the process..... I'm seeking clarity and finding none. |

Under the OLD rules you would have only had the option of waiting.
Under the new rules (re-entry valid as long as your ARC is valid) the simple act of leaving does NOT cancel your visa.
My understanding is that the ONLY way to get your status canceled is to return to Korea, enter, leave (handing in your ARC to cancel your status), return again and enter as a tourist. Find a new job and then do another visa run to complete the new E2.
Better choice might be to try China.
