University CBC requirements for F2 visa?

I've read here that universities require a clean CBC in order to work there. Even for those with an F2 or F4 visa. What exactly do they require? Is it a government requirement or a preference of the university?

I'm in the midst of trying to expunge an arrest from my record. The charges were dismissed, but the state in which I was arrested does NOT expunge records. The best they could do was report the disposition as "dismissed" to the FBI so that it would be listed on my check(good for most anyone but Korean immigration). I've gone through every possible avenue and it seems the only option left is suing the state--a costly route, with no guarantee of success.

I can extend my current E2 visa in August without a new CBC, and am looking to start the distance Applied Linguistics program at Birmingham in the fall. Should I not be able to resolve this criminal record issue before I complete my degree, I will move to another country, perhaps china, to finish it out while working.

I've been with my Korean girlfriend for 2 years and am considering many different possibilites. Should we eventually marry, I'd like to know that I'd be able to use my degree to get a univeristy job in Korea.

I need to decide whether it is worth it to sue the state now, or if I should just wait it out and work in another country pending marriage to my K-girl.

Depends entirely on the uni. They all have their own policies.

My uni has never asked for one on any visa. (E2s needed them for immigration.. not sure about E1s).

Some unis may have a policy though.

If you are on an F-visa then it is strictly an employer requirement.
(I don't know of any uni that requests them for F2 applicants but there may be some. Even when I worked at the Korean National Police University I was NOT asked to provide one).

Kimmi DOES do a check if you apply for an F5.

There is NO LEGAL reason to require it for employment on an F2.

It is NOT an immigration issue for you.

Currently, E1 (visiting professors) do NOT need a CBC BUT not everyone with an MA and working at a university gets an E1. It depends on your job description (visiting professor/guest lecturer would be on an E1 but a "Teacher of a Foreign Language" gets an E2).

Not to pick holes, but there are also situations where this isn't even true, it depends on whoever the hell is interpreting the rules that day at the immigration office.

My coworker with an MA from Cornell was rejected an E1 because his MA was in Asian Studies, and he was working for the English Education department of our university. They said the MA had to be the same 'major' as the department hiring him. His job description has been visiting professor for many years so that was not the issue. I've urged him to go back and try again because I'm pretty sure he's eligible for an E1.. but he's in a several year fit of rage over it haha.

To put this in perspective: We have one or two people with BAs who have an E1, in a less relevant subject, at our uni. My previously mentioned coworker just got screwed by an over-zealous immigration officer apparantely.

Anyway, everything is always open to interpretation. Not always in a good way =)
