Particularly in the case of discharging the ballast water stored in the ballast tank to the sea, the ballast water need not pass through the filtering unit

'need' is a marginal auxliliary verb, which means it can behave like a normal modal verb e.g. he must not go/he need not go and can also behave like a normal verb e.g. he doesn't want to go/he doesn't need to go.
