Hi, my contract say that I will get 5 days vacation that I can select with my employer, and the other 5 days is up to the discretion of the employer. I already took one week, and at this point I have 3 months left. How do I go about bringing up the second week without causing an uproar?
Here is what my contract says---"1) The Employee can get 5 consecutive days of paid vacation. The Employer and the Employee must agree on the time that this vacation is taken. This vacation must be 5 consecutive days from Monday to Friday and cannot be combined with national or school holidays. (i.e. if there is a national or school holiday on a Friday or Monday, the vacation cannot be taken the following or previous week.) Five additional days (excluding national holidays) will be added by the Employer at the Employer�s discretion." |

Which 5 days did you take already? The ones you chose or the ones your employer chose?
If it's the former, ask when they are going to give them to you. The latter, tell them what days you'd like.
Simple.
Causing and uproar? They're your vacation days. Just ask nicely. |

I see a contradiction here - "will" and "discretion."
WILL he give them to you on the days he wants to give them to you?
OR
it's his DISCRETION to give them to you, meaning he may decide not to?
Remember, the Korean version is the legally binding version, so if it's a bad English translation, you're hosed. Good luck. |
