What's the latest on FBI check for transfer?

Ttompatz! Heeeeeeelp! I was under the impression that immigration was still being fairly lenient about visa transfers if a person didn't have the FBI background check - anybody know the latest?

IF they have an FBI check on file you are fine for a transfer.

If they do not and you have not had a change of status you can have 1 change (transfer, extension, change of employer (hagwan sold), etc.) and then need to re-submit. You will need to acknowledge this in writing (they make you sign a form).

If you have already had a change of status since late 2010 you will need new documents and they may not allow a transfer without them.

If they want they can request them ASAP (up to the officer handling your file- this has always been the case).

Thanks for the info - a new visa was obtained in Nov 2010 with an apostilled degree but not an FBI check (just CRC)- do I understand that I can make one transfer to a new school without the check (the check will be in process) ?

Transfer with LOR or up to Nov. 2011 should be possible PROVIDED there hasn't been any other change in your status during your year.
