Hello,
I've been here for 8 years and never broke a contract for any reason.
I am breaking one in 2 months, though on extremely good terms. I work for a uni, but have been accepted to a good M.Ed. program back in Canada so I am departing. I have my exit date and have bought airline tickets. All is well with the uni and my boss.
However, I am a dot-the-I-cross-the-T sort of fella. I know that I should hand in my ARC card when I get to the airport to cancel my visa.
My question is: I don't want any dirty spots at all on my record (should I wish to come back and have a few more go's with immigration) and was wondering if I should get a letter of release, and if so, what to do with it.
I'm probably concerned about nothing, but thought I should ask, as some of you out here have been through a lot on the technical side of things. Luckily, I have only wandered from good place to good place. Never experienced a horror story, just heard about them. |

You only require a LOR should you wish to work at another place before the end date of the contract at the original place. |

I did something similar a few years ago. I gave notice to my school I was returning to Canada. I didn't do anything with immigration. I came back 6 months later and had no problem whatsoever. |

I am in a similar situation. I am quiting. I gave notice. I will be going back to the US momentarily. But my ARC card does not expire until November. Does that mean I have to wait until after it expires to get a new job and a new visa? |

I come here today to praise you, Sir, not to bury you, though I do have a minor quibble with your phrasing.............. on the technical side of things.
You did not come right out and say it, but since you are a "dot-the-I-cross-the-T sort of fella", and "leaving on extremely good terms", I am assuming you are ending your contract through provisions laid out in the contract. Therefore, you have not broken the contract, but have in fact abided by it. You have merely exercised a provision stipulated in the contract, and thus you can leave Korea with your No-Break record intact.

If I were you, I would call immigration to make sure, or ask someone who can speak Korean to call for you. Better safe than sorry! |

Handing in your ARC as you leave cancels your current status of sojourn and closes your file as far as K-immigration is concerned.
The LOR is only required if you plan to change jobs/sponsors without canceling your status of sojourn (in lay terms - transfer from one job to another).

As long as you hand in your ARC to the immigration officer as you leave Korea you will have no problems returning on a new visa when you are ready.
If you fail to hand in your ARC you will have to wait until it expires before you can come back and get a new job.

What about getting your pension money back? If you leave a couple months early with the permission of your employer, do you need a letter of release to get your pension money, or can you get it with just a plane ticket? |

Plane ticket out of the country, passport, ARC and bank information (for the deposit to be sent to).

To all who answered my post, thank you very much.
It is going to be a shame leaving Korea after so much time here. It's not a perfect place, but since when is Canada or Oz? I've come to get used to being here more than anything else. What's life going to be like without overpriced meat, ridiculous fashion, drunk ajosshi's, the beautiful countryside and so on?
I guess it will suck because, most of all, going back to school after so many years is going to be tricky. Gravy will be much easier to find though. |
