I know, this sort of stuff has been asked before, but...
In Wisconsin, we like to drink, and a first-time DUI isn't a misdemeanor or a felony, but a traffic violation on the same level as a speeding ticket. I think it may be the only state in the nation like that.
That being said, I did get prints taken and booked/photographed and that whole deal, so in that sense it's not much different than in other states except it's classification in the system in Wisco.
I realize that no matter what happens, I'm still in with every other person in the somewhat ambigious Visa-with-a-DUI boat, but have any other Wisconsinites had any experience with this? Secondhand experiences?
Any input helps. I hate getting excited for something and then it all comes crashing down, albeit it seems like those of us in our early/mid twenties sure are getting a lot of that these days.

Does anything show up on your FBI check?
If not, you are good to go.
If it does, then it is a crap shoot whether you can get a visa or not. Some people have gotten them with DUIs and others have been denied. It all depends on who is reviewing the application.
Kimmi doesnt care what kind of law Wisconsin has, all they care about is if something is on the FBI check or not. |

Did you go to jail? If so, it's on your record...Hell, there no shame in it, just proceed to go on and find a system "loopwhole". as there is ALWAYS at least one to be had)...

Yeah, I guess what I felt the discrepancy might be is that, from our classification of crimes, if the speeding ticket is on there, then the DUI will be, and wondering whether if it isn't on there (the speeding ticket) that the DUI would follow suit since it's different in some ways and not another?
But yeah, I should just pay the money and get the check done for myself. Sometimes I wish it was more concrete as far as things go, but it looks like a bit of luck and (possibly) a heap of bullshit and groveling may be the trick, again...
I went to the county jail to do the booking, if that's what you mean. That how I got the prints and what not.
Could you elaborate on these loopholes? I'm not terribly familliar with what that could mean, and you seem to hint and them being a shady option.... |

Not really sure about FBI, but each state has its own jursicdictional pratice (per se)...
However, think your best bet would be the livescan..you can go there in person and pick it up using a virtural adress as your residental or you can send it in..( probably a better opition).. |

If the DUI was a while ago and shows up on the FBI CBC, you can try to get it expunged. It might take some time, but it will get it cleared. However, as said earlier, if you didn't go to jail and/or weren't fingerprinted, you might have a chance. The only way to know is to get it.
For what it's worth, speeding tickets and traffic violations don't show up, though I don't think DUI is in the same class as those and I would expect any arrest to show up. As far as I know, it only shows up if you've been fingerprinted. |

Unfortunately I have no experience with the DUI background check issue. Maybe try getting a state cbc first, if it shows up-that may be a good indication. If not, you can always use it as leverage at your VISA appointment even if it is not required. It is a lot quicker than the FBI one.
Anyways, I am also from Wisconsin (Madison) and have just accepted a position in Korea for this coming September. I got an offer through EPIK for a public school, but still waiting on the VISA. Where is korea are you hoping to be placed? |

Your speeding tickets and points should not show up on the FBI CBC, so this sounds like it shouldn't either.
Did you get points?
Have the points cleared?
If yes to both, then this being a traffic offense might not appear.
Go ahead and order the FBI CBC and find out. If it's clean you're good to go.
If it's on the FBA CBC, you can probably find a WI attorney who can get it expunged to allow you to get a job in Korea.
Do NOT submit your CBC with the conviction, however. Get it expunged first. If you submit the CBC with the conviction, you will likely be rejected and it may remain in the records of Korean Immigration even after you get it expunged in the US. |

Thanks guys, especially for the universally helpful and respectful responses. This place sometimes feels like the area by the dumpsters where the emo kids hang out, smoke off-brand cigarettes and talk about how much they hate everything in their lives.
Anyway, Britt, I am from the Madison area too (UW Grad). From my perspective, I like the idea of teaching and am more than capable (and mildly experienced) in the art, but I am looking for a finally-jumped-off-the-high-dive type of experience, and I feel like how Seoul is becoming a true 'global city' (Geo 305...)would be the highest board I could jump from.
Again, too, thanks everyone. The DUI was 13 months ago, and it sounds like Wisconsin only expunges if you were a minor or had a .08 -.099 BAC (barely buzzed) when breathalyzed. I was neither. I was fingerprinted too. I think I'll order the FBI check soon, and see what shows up. Hopefully it doesn't take ten weeks for a 'test' to come back to me. |

Let us know how it goes, I got some old Wisco friends who are in a similar boat. Made a bad call back in college and might be totally out of the game here now. |
