I believe you have to get a criminal background check from your home country if doing an E2 visa transfer. The background check has to be less than 6 months old, but Ive been in Korea for the last 6 months. Do I have to lie to the police back home - pretending to be living there?? Or do I get the police to date-stamp a document showing I was living there up until 8 months ago?
Another question (unrelated): most E2 visa are for 13 months - do you need a letter of release to get another job without a visa-run when you finish a 12 month contract? |

lol
lying to a police ain't gonna help you. you now need to fetch a fed level cbc with some rubber stampings. |

I don't think you need another cbc for a e2 visa transer...
You're completely doing more work for yourself. Get the CBC here in Korea. Plenty of people (including me) have done so.
Yes it was an FBI CBC with an apostille since that was your next question. |

Same province/city or different one?
My opinion, based on what I've read and experienced, is that if you're in the same province/city you're OK. If not, you'll need a new FBI CBC.
You don't need an apostille (though others here may argue this point). You can swear an affidavit at the US Embassy and same some time. Still will need it notarized by the FBI.
Get in touch with your state rep's office regarding expediting the CBC. Can take a while. |

Would be interested to find out how to get the CBC in Korea, for non-Americans, if possible.
I read this:

Yes, but you will need to supply a verified (by the korean consulate in your home country) and apostilled copy of your degree and national criminal background check from you home country. It's not a full E-2 visa process (you dont need to re-apply and do a visa run), but those are the documents you will need for a second status change since the visa changes came into effect last year. |

Would make no sense to get a document from the police abroad saying I was not in my country for the last 6 months!
Surely I can do it here whether it's the same province or not? |
