How much notice do I have to give?

Does anyone know if the labour law states how much notice I have to give to quit my job? Or is it just something determined by contract?

If its on the labour boas a link/source will be most helpful. I have been searching for hours and can't find a thing.



Also what if the situation is I am backing out on renewing AFTER the notice required in my contract (2 months) but I haven't signed a new contract.

Boss is trying to get me to stay past contract date or not pay me severance/flight.

Well, you need to give them a chance to pay. You should let them know you can't stay. Find a goshiwon or something after your contract period and try to collect on it. If it becomes a problem at that point, then I think you can take legal action. You can change your visa and stay longer.

Hi,

it should state in your contract the required notice. In relation to the backing out, it is a tricky one, I guess it depends on how arsy your boss is and what evidence exists that you agreed to renew in the first place. Is it your word against his?

I agree with Koreatimes, I would explain to them in a calm fashion that you have personal circumstances and you can not stay, give them a chance to pay you the money which they legally owe you, if they fail to do this then you can choose your next move.

Be careful, it is Korea and as much as we will all agree on what is fair and what should be done, he has your money and if he is really stubborn you may have a problem. Be smart and do not give him anything to use against you, no lates or absences or anything.

If you're quitting and going home, then no notice is necessary.

If you're wanting to work somewhere else in Korea, then you should probably negotiate something with your school. Usually it is 30 days but the school is going to want you to stay until your replacement arrives.

There is no legally required minimum notice for you to give. You can up and leave at any time, including in the middle of a class.

She's already given notice that she WILL stay, so if she quits now, I doubt she could get her severance
