I was in hospital for three weeks earlier this year for an operation. I was owed slightly more than three weeks vacation at the time. I was wondering how much sick leave is normal for a year under Korean Labour Law and if I can take that out of the time I was in hospital.
Also even if the three weeks was taken out of my vacation, I had two days left of vacation from last year. Is it possible to have it carried over to this year or do you have to use up all vacation in the year you are eligible for it.
During the time I was in hospital I was scheduled to work a week.

Sick leave is not covered in the Labor standards act.
It is totally a contractual matter. |

If you are in a public school then your "sick leave" of up to 45 days per year is covered both as paid leave and if extra time was needed/taken as unpaid leave. You can negotiate to have your unpaid leave taken as part of your annual vacation time but they don't have to allow it.
If you are at a hagwan it is between you and your boss. There is NOTHING in labor law in regards to "sick leave".
