The District Court in Brisbane heard Deokhawn Cha had previous convictions in Korea for serious sexual assaults.

Cha, 30, was in Australia on a work visa and met a woman, also 30, through a website which helped Koreans get work.

Prosecutor Dennis Kinsella said the woman had wanted to work on farms and Cha had agreed to travel with her from Gin Gin to Emerald in central Queensland.

They had stayed at a caravan park and also camped out in a two person tent.

Mr Kinsella said on the day of the offences, Cha drove the woman to a remore area near Emerald where he asked for sex and when she refused he sexually assaulted her. Cha then put his hands around her throat.

He said the woman had been unable to breathe and had, in an effort to delay things, told Cha to find a more secluded spot.



Cha then drove the woman to bushland where he raped her.

Mr Kinsella said Cha drove the woman to the home of some Korean friends where the victim told a woman she had been raped.

Police were called but Cha left and stole $650 in property from the house.

Mr Kinsella said Cha was arrested in Brisbane's Queen St Mall trying to sell some of the property.

It was worrying that Cha had a previous conviction for rape in Korea, Mr Kinsella added.

The woman, who had since returned to Korea, wrote a victim impact statement which told how the offences had a deep impact on her including losing her trust of people.

Cha pleaded 11 charges including rape, two of sexual assault, assault occasioning bodily harm, six of fraud and burglary and stealing, in May 2009.

Barrister Lars Falcongreen, for Cha, said his client was deeplv remorseful and Cha's guilty plea had saved the expense of bringing witnesses from Korea.

He said Cha spoke little English and was virtually isolated in jail as his family could not afford to visit him.

Judge Milton Griffin, SC, said he accepted Cha was remorseful but it had been a terrifying experience for a vulnerable woman.

He sentenced Cha to 9 1/2 years jail and added while it was a borderline case, he would not declare it a serious violent offence.

Nope. I've seen HBO's 'Oz' so I think I know how this works, thank you very much.

I don't think Korean prisons are as violent. However they are harsh in other ways like vary spartan environment and little heating in the winter. So lots of prisoners get pretty severe frostbite.

yeah, we tend to hand out working visas like candy. particularly to koreans.

Ok, one bad apple but if we follow the Korean way of thinking then Australia should introduce a harder way to obtain a Working Holiday Visa.

How about criminal background checks [notarized and apostilled] for Koreans who wish to obtain a WHV?

i'm surprised they don't have to jump through hoops already. they over-stay their visas almost as much as the english.

I was banned a year or more ago from there - they just like constantly brining me up. Smile
