Is the FBI CBC actually required for SMOE renewal?

I thought that an FBI criminal background check was required for all Americans on E2 visas. I have not had one done before. I am renewing my contract with SMOE, however the document they provided says they just need a "domestic criminal check".

My school has no clue about these things, so I followed up with the lead coordinator for SMOE. Honestly, he didn't seem to know anything definitive either. He just said something to the effect that eventually I should get it, but that it was not urgent to have it before the start of my new contract.

I don't want to go through the hassle of doing the FBI CBC if it is not necessary. Can anyone tell me what's really up with this?

If you have not had a change of status in 2011 and will get the renewal paperwork done before Jan 1, 2012 then no worry.

If you will renew after Jan 1, 2012 then you will need one (FBI check with apostille and (photo)copy of your degree with an apostille) for an extension of your status of sojourn as well as a (photocopy) for the MOE.

You can do the renewal up to 60 days prior to your ARC expiry.

Good question.

I know that SMOE requires national CBC's now from all new hires, including F visa holders. But if you're an F visa holder and you were hired before that requirement came into effect then I'm not sure what the answer is. I have a feeling if you ask them if you need it they will say yes. But will they ask you for one if you don't draw their attention to it?

Also, will the new department of education requirements affect this at all?

@ttompatz I'm still a little confused. I have been at my school for several years, so there has not been a change of status. The renewal paperwork should be completed before January 2012, however the contract term will start March 1st, 2012, and my ARC card doesn't expire until late March 2012 so I won't be able to actually file for an extension until after the new year.

You probably will need one. Even if you don't, better safe than sorry. It can take up to two months (or longer) to finish it so I'd get started ASAP.

The good news is, once it's done, it's done for all future visas. I submitted mine a while back in anticipation of renewing with SMOE next year, at the same time as you. As it turns out, I won't be with SMOE next year but I'm glad I got that done anyway.

Thanks everyone. I'm just going to go ahead and do the FBI background check just in case. I should be able to get in just in time if it is needed.

Change of status would include your extensions.

If you have not had an extension or change in 2011 then you get 1 free pass to do so in 2011.

If you have had a change of status then you will need new docs.

If you will do the extension in 2012 you will need a new set of docs (based on your description of your circumstances); FBI check with apostille and (photo)copy of your degree with an apostille (unless the one they have on file is a copy with apostille).

Start NOW because the longer you delay the longer it will take and if you are E2 and do not have them on file your application for extension of your ARC in 2012 will be denied (30 days to leave the country).

If you are still unsure, contact immigration (yourself).
They will tell you what you need to submit.

I recently did my change of status in 2011. I had a state cbc from the U.S. and signed a paper stating that I will get an FBI background check next time around. However, with the new MOE requirements, what will my status be in Feb 2012?
