Hi Everyone,
I got laid off from my job a few weeks ago. Even though the management has been great, and is willing to renew my E-2 visa for a few more months, sign a letter of release, and write a good recommendation, I have a few questions:
1. Some employers have said they want to hire me, but can't switch the visa from under 7 months. Is that true?
2. Should I not get a job and leave Korea, do I get my documents back (including the Criminal Background check)?
3. If I want to return to Korea, will I need to submit a criminal background check again?
4. What is the fastest time available to do it? (My guess is three months).

1) untrue.
2) No, your documents are gone. Kimmi will NOT return them.
3) If you get a new visa = yes.
4) 60 minutes = leave Korea, hand in your ARC (canceling your visa), return on the next flight and start the application process again.
If your old job let you go and you have a LOR you can pop into your local immigration office, change to a D10 (looking for work, find a new job and switch back to an E2 when you find a job without the need for new documents or a visa run. Cost is 50k won to switch to the D10 and 50k to switch back to an E2 when you find a job.

Wow! I never knew of that option. Is it only with a LOR? How long can you stay on this D10? Is it a new option? What if your job ends and you want to look for another job? Can you do this as well? |

Yes it's new. It went into effect October of this year. You don't need an LOR if your contract is finished, but you must apply for the status change before your ARC expires. It's valid for 90 days. |
