Hi. I've been searching posts on this site as well as looking on the Korean immigration site, but I'm still unsure of just exactly what documents I need to provide when I go to renew my visa in March 2012. Any help would be much appreciated.
I've been in Korea since Feb 2009. I worked for a high school for the first year and submitted my original degree certificate, transcripts, plus a national criminal background check (I'm from the UK) when I applied for the E2 visa. In March 2010 I switched to work for a University and they transferred the visa over. I didn't need to show the degree or the CRC again. They issued me with a 2 year E2 visa, as my contract was for 2 years.
My question is: will I be required to submit the notorised/apostilled version of the degree and CRC when I go to renew in March 2012? Are teachers who work at Universities on E2 visas required to submit these docs again under the new rules? |

Better ask tompatz but as far as I know...
Only if you have left the country for longer than three months
Or if the original documents were not apostilled |

I haven't left the country for more than 3 months at a time, but the original documents were not apostilled or notorised. I'm sure there was some sort of verification process though when I submitted them in 2009.
Korean immigration has been contacted twice directly. The first time, about a month ago, I was told I didn't need any new documents to renew. Just go there with my passport, ARC, contract etc and it would be a straightforward renewal.
However, yesterday was a different story. The agent told me I have to resubmit my degree with apostille and CBC also with apostille.

On an E2 you MUST have appostilled versions of your degree (COPY) and CBC on file at immigration. (visa class requirement). You may be able to switch to an E1 to get around it since you are at a university.
The announcement was made in 2010. At that time people complained that it would take many months to obtain said documents from home so E2s were given 1 year's (2011) grace to obtain said documents and come into compliance during which time an extension was possible without new copies.
Now, in 2012, EVERYONE must be in compliance - newbies applying in 2011 were at the time of their application and those extending have had a year to get into compliance.
Not knowing (or claiming to not know) about it won't work as an excuse (ignorance of the law never is a defense). If you personally went down and checked and were told they were not needed then you may, if you go to the same clerk, have some allowance - if not, then get them or face not being renewed.
To the best of my knowledge there are no exceptions but I am also not an immigration officer making the decision on your file at extension time.

without a visa run = no.
without new documents (other than proof of education) = yes.

Thanks ttompaz for the info. I suppose I'm going to have to get the apostilled versions of the the docs to be absolutely sure.
I was reading the immigration website requirements for the E2 though and it said:
[i]Degree certificates
- Got Apostille or verified from the Korean embassy in foreigner's home country �confirmation certificate from the university� or �graduation certificate including degree achievement facts� or �diploma or degree copy�
To me this seems to say you need an apostille OR the 'confirmation certificate from the university'.
I'm wondering if the 'confirmation certificate' is what they already have on file after verifying my degree back in 2009. |

Different rules for different countries.
Canadians need their documents certified by the Korean consulate in Canada. Canada is not a signatory to the apostille treaty.
The other 6 nations need to have an apostille on their documents.
As of Dec. 2010 immigration has required people to submit a "certified true copy" of their degree with an apostille. They quit accepting originals because they will NOT return the documents that are submitted to them.
For those who were IN Korea they were given 1 year's grace (2011) to get into compliance (get new documents from home). The grace period was given because of the delays in getting documents for those who were here and not in compliance with the new rules.
Get them and get them in or pick a new country to work in come renewal time.

Originally from UK, so submitted an apostilled CRB, but no apostille on the Uni Cert.
Haven't left the country for more than 3 months. Therefore should I get a my uni cert/copy of uni cert notarised and apostilled in preparation? |
